The infringements concern Member States' failure to respect their legal obligations arising from the Gas Regulation No 715/2009 of the European Parliament and of the Council of 13 July 2009 on conditions for access to the natural gas transmission networks which replaced on 3 March 2011 the Regulation (EC) No 1775/2005.

The formal approval of congestion management procedures by regulators should be clearly stated in the Regulation 1775/2005 in order to ensure an efficient implementation.

(29) Member States should establish, on the basis of objective, transparent and non-discriminatory criteria, rules governing the bearing and sharing of costs of grid connections and grid reinforcements and for technical adaptations needed to integrate new producers of electricity produced from high efficiency cogeneration, taking into account guidelines and codes developed in accordance with Regulation (EC) No 714/2009 of the European Parliament and of the Council of 13 July 2009 on conditions for access to the network for cross-border exchanges in electricity and repealing Regulation (EC) No 1228/2003[32] and Regulation (EC) 715/2009 of the European Parliament and of the Council of 13 July 2009 on conditions for access to the natural gas transmission networks and repealing Regulation (EC) No 1775/2005[33].

Directive 2003/55/EC of the European Parliament and of the Council of 26 June 2003 concerning common rules for the internal market in natural gas (4) and Regulation (EC) No 1775/2005 of the European Parliament and of the Council of 28 September 2005 on conditions for access to the natural gas transmission networks (5) have made significant contributions towards the creation of such an internal market in natural gas.
La directive 2003/55/CE du Parlement européen et du Conseil du 26 juin 2003 concernant des règles communes pour le marché intérieur du gaz naturel (4) et le règlement (CE) no 1775/2005 du Parlement européen et du Conseil du 28 septembre 2005 concernant les conditions d'accès aux réseaux de transport de gaz naturel (5) ont contribué pour beaucoup à la création d'un tel marché intérieur du gaz naturel.

Given the scope of the amendments that are being made herein to Regulation (EC) No 1775/2005, it is desirable, for reasons of clarity and rationalisation, that the provisions in question should be recast by bringing them all together in a single text in a new Regulation,
