H. considérant que dans l'affaire précitée, Kadi et Al Barakaat International Foundation contre Conseil et Commission , la Cour a annulé le règlement (CE) n° 881/2002, pour autant qu'il concernait M. Following the judgment of the Court of Justice of the European Communities of 3 September 2008 in Joined Cases C-402/05 P and C-415/05 P: Judgment of the Court (Grand Chamber) of 3 September 2008 — Yassin Abdullah Kadi, Al Barakaat International Foundation v Council of the European Union, Commission of the European Communities, United Kingdom of Great Britain and Northern Ireland, Regulation (EC) No 881/2002 should be amended to provide for a listing procedure ensuring that the fundamental rights of the defence and in particular the right to be heard are respected.
À la suite de l’arrêt rendu le 3 septembre 2008 par la Cour de justice des Communautés européennes dans les affaires jointes C-402/05 P et C-415/05 P: arrêt de la Cour (grande chambre) du 3 septembre 2008 - Yassin Abdullah Kadi et Al Barakaat International Foundation/Conseil de l’Union européen, Commission des Communautés européennes et Royaume-Uni de Grande-Bretagne et d’Irlande du Nord, le règlement (CE) no 881/2002 devrait être modifié afin d’instituer une procédure d’inscription sur la liste garantissant que les droits fondamentaux de la défense et en particulier celui d’être entendu sont respectés.

Ruling on the action, the Court of Justice then annulled the regulation freezing Mr Kadi’s funds, holding that it had been adopted in breach of his fundamental rights but maintaining its effects for a period of three months in order to allow the Council to remedy the infringements found.
Statuant sur le litige, la Cour a ensuite annulé le règlement de gel des fonds en considérant que celui-ci avait été adopté en violation des droits fondamentaux de l'intéressé, tout en maintenant ses effets pendant une période de trois mois pour permettre au Conseil de remédier aux violations constatées.

Finally, regarding Yassin Al-Qadi, I should like to remind the honourable Member that, in accordance with the October 2001 decision of the UN Security Council Sanctions Committee, the Commission, in its Regulation (EC) No 2062/2001, an implementing regulation, placed Mr Qadi on the list of persons, groups and entities covered by the freezing of funds and economic resources.
