[2] Preparatory actions, based on article 49, point 2b of the Financial Regulation N°1605/2002 and article 32, point 2 of the Implementing Rules on the Financial Regulation (N°2342/2002), are intended to prepare proposals with a view to the adoption of future Community actions.

In accordance with Article 54(2)(b) of Council Regulation (EC, Euratom) No 1605/2002 of 25 June 2002 on the Financial Regulation applicable to the general budget of the European Communities , such activities could for example include following the development of coordination and consultation procedures on security-related matters, carrying out research of benefit to the development and promotion of the programmes and providing support in the development and implementation of the Public Regulated Service (PRS) pilot project.
Conformément à l’article 54, paragraphe 2, point b), du règlement (CE, Euratom) no 1605/2002 du Conseil du 25 juin 2002 portant règlement financier applicable au budget général des Communautés européennes , ces actions pourraient être, par exemple, de suivre la mise au point des procédures de coordination et de consultation en matière de sécurité, de mener à bien des recherches utiles au développement et à la promotion des programmes, ou encore d’apporter son soutien pour le développement et la mise en œuvre du projet pilote de service public réglementé.

The Joint Undertaking should operate in accordance with Article 208 of Regulation (EU, Euratom) No 966/2012 of the European Parliament and the Council of 25 October 2012 on the financial rules applicable to the general budget of the Union , which replaced Article 185 of Regulation No 1605/2002, and should adopt financial rules which should not depart from the framework Financial Regulation except where its specific needs so require and with the Commission’s prior consent.

The latter considered that the derogations from the no-profit rule laid down in Article 109(2) of Council Regulation No 1605/2002 could only be enshrined in a separate regulation based on Article 279 of the EC Treaty and intended to introduce these derogations into the Financial Regulation itself by amending it.

Although the Court confirmed that under the rules of Regulation 1408/71 reimbursement could only be made according to the tariffs of the Member State where the treatment was provided, it held that, under the principle of freedom to provide services, the insured person was entitled to additional reimbursement from the Member State of insurance if the latter's legislation would have provided for a higher level of reimbursement had the hospital treatment been received there.
Bien que la Cour ait confirmé qu'en vertu des dispositions du règlement 1408/71 le remboursement ne pouvait se faire qu'aux tarifs de l'État membre dans lequel le traitement est dispensé, il a été retenu qu'au nom du principe de la libre prestation de services, la personne assurée pouvait prétendre à un remboursement complémentaire de la part de l'État membre d'assurance si la législation de celui-ci prévoit un niveau supérieur de remboursement pour un tel traitement hospitalier reçu dans l'État d'assurance.
