IN-CONTEXT TRANSLATIONS

The international transport of dangerous goods is regulated by the European Agreement concerning the International Carriage of Dangerous Goods by Road (ADR)*, the European Agreement concerning the International Carriage of Dangerous Goods by Inland Waterways (ADN)* and the Regulations concerning the International Carriage of Dangerous Goods by Rail (RID)*.

Where relevant, this section shall provide information on the transport classification for each of the UN Model Regulations: the European Agreement concerning the International Carriage of Dangerous Goods by Road (ADR) (7), the Regulations concerning the International Carriage of Dangerous Goods by Rail (RID) (8) and the European Agreement concerning the International Carriage of Dangerous Goods by Inland Waterways (ADN) (9), all three of which have been implemented by Directive 2008/68/EC of the European Parliament and of the Council (10), as well as the International Maritime Dangerous Goods (IMDG) Code (11) (sea) and the Technical Instructions for the Safe Transport of Dangerous Goods by Air (ICAO) (12) (air).

Strengthening of the rights of rail passengers should build on the existing system of international law on this subject contained in Appendix A — Uniform rules concerning the Contract for International Carriage of Passengers and Luggage by Rail (CIV) to the Convention concerning International Carriage by Rail (COTIF) of 9 May 1980, as modified by the Protocol for the modification of the Convention concerning International Carriage by Rail of 3 June 1999 (1999 Protocol).

4. The carriage of dangerous goods as hand luggage, registered luggage as well as in or on vehicles which, in accordance with this Title are carried by rail, must comply with the Regulation concerning the Carriage of Dangerous Goods by Rail (RID).
4. Le transport de marchandises dangereuses en tant que colis à main, bagages ainsi que dans ou sur des véhicules qui, conformément à ce titre, sont transportées par rail, doit être conforme au règlement concernant le transport international ferroviaire des marchandises dangereuses (RID).

In order to ensure coherence between Community legislation and international provisions, the common position is compatible with COTIF/CIV rules (the Convention concerning international carriage by rail and its annex concerning the uniform rules concerning the contract for international carriage of passengers by rail) as far as transport contracts, liability of railway undertakings in respect of passengers and their luggage, delays, missed connections and cancellations are concerned.

It will be remembered that Directive 97/23/EC, which concerns the placing on the market of pressure equipment, excluded transportable pressure equipment, hereafter referred to as TPE, from its scope, stating that such equipment would be dealt with as soon as possible by forthcoming Community Directives, in that they are covered by the provisions of the European Agreement concerning the International Carriage of Dangerous Goods by Road (ADR) and of the Regulations concerning the International Carriage of Dangerous Goods by Rail (RID) as transposed into Community law in Directives 94/55/EC and 96/49/EC.
