5. Where, after giving the user of the EU Ecolabel the opportunity to submit observations, any competent body which finds that a product bearing the EU Ecolabel does not comply with the relevant product group criteria or that the EU Ecolabel is not used in accordance with Article 9, it shall either prohibit the use of the EU Ecolabel on that product, or, in the event that the EU Ecolabel has been awarded by another competent body, it shall inform that competent body.
5. Lorsqu'un organisme compétent constate, après avoir donné à l'utilisateur du label écologique de l'UE l'occasion de présenter ses observations, qu'un produit porteur du label écologique de l'UE ne répond pas aux critères applicables au groupe de produits concerné ou que le label écologique de l'UE n'est pas utilisé conformément à l'article 9, il interdit l'utilisation du label écologique de l'UE sur ce produit ou, si le label écologique de l'UE a été attribué par un autre organisme compétent, il en informe celui-ci.

2. As from the date referred to in paragraph 1, the Member State concerned shall prohibit fishing either for the stock or group of stocks whose quota has been exhausted, in the relevant fishery or when carrying on board the relevant fishing gear in the geographical area where the maximum allowable fishing effort has been reached, by all or part of the fishing vessels flying its flag and in particular the retention on board, the transhipments, the relocations and the landings of fish taken after that date and shall decide on a date up to which transhipments, transfers and landings or final declarations of catches are permitted.
2. À compter de la date visée au paragraphe 1, l’État membre concerné interdit la pêche pratiquée soit pour le stock ou le groupe de stocks dont le quota a été épuisé dans la pêcherie concernée soit par une partie ou la totalité des navires de pêche battant son pavillon lorsqu’ils détiennent à bord l’engin de pêche en question dans la zone géographique où l’effort de pêche maximal autorisé a été atteint, ainsi qu’en particulier la conservation à bord, le transbordement, le déplacement et le débarquement de poissons pêchés après cette date, et fixe une date jusqu’à laquelle les transbordements, les transferts et les débarquements ou les déclarations définitives de captures sont autorisés.

4. If, after having conducted a strengthened political dialogue, a Party, informed in particular by reports by the International Atomic Energy Agency (IAEA), the Organisation for the Prohibition of Chemical Weapons (OPCW) and other relevant multilateral institutions, considers that the other Party has failed to fulfil an obligation stemming from paragraph 1, it shall, except in cases of special urgency, supply the other Party and both the ACP and the EU Councils of Ministers with the relevant information required for a thorough examination of the situation with a view to seeking a solution acceptable to the Parties.
4. Si, malgré un dialogue politique renforcé, une partie, informée en particulier par les rapports de l'Agence internationale de l'énergie atomique (AIEA), l'Organisation pour l'interdiction des armes chimiques (OIAC) et des autres institutions multilatérales pertinentes, considère que l'autre a manqué à une obligation découlant du paragraphe 1, elle fournit à l'autre partie ainsi qu'aux Conseils des ministres ACP et UE, sauf en cas d'urgence particulière, les éléments d'information utiles nécessaires à un examen approfondi de la situation en vue de rechercher une solution acceptable par les parties.

(b) the prohibition to challenge after completion of the research and development the validity of intellectual property rights which the parties hold in the common market and which are relevant to the research and development or, after the expiry of the research and development agreement, the validity of intellectual property rights which the parties hold in the common market and which protect the results of the research and development, without prejudice to the possibilty to provide for termination of the research and development agreement in the event of one of the parties challenging the validity of such intellectual property rights;

(b) are prohibited after completion of the research and development programme from challenging the validity of intellectual property rights which the parties hold in the common market and which are relevant to the programme or, after the expiry of the agreement, from challenging the validity of intellectual property rights which the parties hold in the common market and which protect the results of the research and development;
