1a. Where the Board exercises the powers conferred on it by this Regulation, it shall be subject to binding regulatory and implementing technical standards developed by EBA and adopted by the Commission in accordance with Articles 10 to 15 of Regulation (EU) No 1093/2010, to any guidelines and recommendations adopted by EBA in accordance to Article 16 of Regulation (EU) No 1093/2010 under the relevant provisions of Directive [BRRD] and to any decisions of EBA in accordance with Article 19 of Regulation (EU) No 1093/2010 under the relevant provisions of Directive [BRRD].

Obviously the revision must be conducted with care: tried and tested practice – including not only the division of the relevant provisions into two directives and the distinctions between service, works and supply contracts but also the classification into A and B services – should not be called into question. The predominantly local nature of the B services justifies the existence of special provisions in their regard. There are, however, grey areas in relation to various types of financial service, and clearer provision is needed, too, with regard to the classification of emergency services.

In very exceptional circumstances, if and to the extent compliance with a provision of this Directive is incompatible with compliance with the law to which the non-EU AIFM or the non-EU AIF marketed in the Union is subject, it should be possible for the non-EU AIFM to be exempted from compliance with the relevant provision of this Directive if it can demonstrate that: it is impossible to combine compliance with a provision of this Directive with compliance with a mandatory provision in the law to which the non-EU AIFM or the non- EU AIF marketed in the Union is subject; the law to which the non-EU AIFM or the non-EU AIF is subject provides for an equivalent rule having the same regulatory purpose and offering the same level of protection to the investors of the relevant AIF; and the non-EU AIFM or the non-EU AIF complies with that equivalent rule.

3. Ad hoc aid fulfilling all the conditions of Chapter I of this Regulation, as well as the relevant provisions of Chapter II of this Regulation, shall be compatible with the common market within the meaning of Article 87(3) of the Treaty and shall be exempt from the notification requirement of Article 88(3) of the Treaty provided that the aid contains an express reference to the relevant provisions of this Regulation, by citing the relevant provisions, the title of this Regulation and its publication reference in the Official Journal of the European Union
3. Individual aid granted under a scheme referred to in paragraph 1 shall be compatible with the common market within the meaning of Article 87(3) of the Treaty and shall be exempt from the notification requirement of Article 88(3) of the Treaty provided that the aid fulfils all the conditions of Chapter I of this Regulation, as well as the relevant provisions of Chapter II of this Regulation, and that the individual aid measure contains an express reference to the relevant provisions of this Regulation, by citing the relevant provisions, the title of this Regulation and its publication reference in the Official Journal of the European Union

The rapporteur draws the legislator's attention to the fact that the simple replacement in Articles 38 and 39 of the VAT Directive of the term "supply of gas through the natural gas distribution system" by the term "supply of gas by pipeline or by vessel for transporting natural gas" does not take away completely the ambiguity of the text. Furthermore, although the terms in the relevant provisions change, the title of Section IV of Chapter 1 of Title V, where these provisions are included, remains unchanged ("Supply of goods through distribution systems"). Finally, and in order to respond to concerns expressed about the coverage under the proposed wording, the rapporteur proposes to specify that trasnsport by vessel should be "from pipeline to pipeline".
Enfin, et pour répondre aux préoccupations exprimées concernant le champ d'application couvert selon le libellé proposé, le rapporteur suggère de préciser que le transport par navire devrait se faire "de gazoduc à gazoduc". Le Conseil devrait saisir cette occasion pour supprimer toute ambiguïté dans le texte final.
