The aid must not have undue negative effects. Examples of such undue negative effects would be the creation of excess capacity by the aided investment in a market which is in absolute decline; or the granting of an aid amount that would exceed the regional aid ceiling applicable to the region in question; or that the aid would have causal effect for the relocation of existing/closed down activities to the aided establishment; or that the aid would lure away investment from a region, which has the same or a lower level of economic development than the region where the aided investment takes place.

(b) the Governor in Council is prepared to authorize the allocation of moneys from the moneys appropriated by Parliament for the purposes of making relocation grants under this Part for the transportation plan forming part of the accepted plan in respect of which the application is made.

(4) When a relocation grant is recommended by the Agency in respect of a transportation plan accepted by it, the Minister of Transport may, subject to such terms and conditions as he may consider necessary to effect the financial plan attached to the accepted plan in which that transportation plan was set out, authorize the payment out of moneys appropriated by Parliament therefor of an amount, not exceeding the amount limited under subsection (2), to defray part of the costs of carrying out the transportation plan.
(4) Lorsque l’Office recommande le versement d’une subvention de déplacement de lignes en ce qui concerne un plan de transport qu’il a accepté, le ministre des Transports peut, sous réserve de telles modalités qu’il peut juger nécessaires à l’exécution du plan de financement annexé au plan accepté dans lequel ce plan de transport a été exposé, autoriser le versement, sur les crédits affectés à cette fin par le Parlement, d’une somme ne dépassant pas celle dont le paragraphe (2) fixe les limites, afin de couvrir une partie des frais d’exécution de ce plan de transport.

Relocation shall only be proposed for applicants belonging to nationalities for which the proportion of first instance decisions granting international protection is 75% or higher, based on the latest available updated Eurostat quarterly data.The 75% recognition rate threshold has two objectives: to ensure that all applicants who are in clear and urgent need of protection can enjoy their protection rights as soon as possible; and to prevent that applicants who are unlikely to obtain asylum are being relocated and unduly prolong their stay in the EU.
La relocalisation ne sera proposée que pour les demandeurs possédant les nationalités pour lesquelles la proportion des décisions de première instance accordant une protection internationale est égale ou supérieure à 75 %, sur la base des dernières données trimestrielles d’Eurostat actualisées disponibles.Ce seuil de 75 % poursuit deux objectifs: faire en sorte que tous les demandeurs ayant un besoin manifeste et urgent de protection puissent jouir de leur droit à une protection dès que possible; et empêcher la relocalisation des demandeurs dont il est improbable qu'ils se voient accorder l’asile et qui, de ce fait, prolongeraient indûment leur séjour dans l’UE.

Relocation pursuant to this Decision shall be applied only in respect of an applicant belonging to a nationality for which the proportion of decisions granting international protection among decisions taken at first instance on applications for international protection as referred to in Chapter III of Directive 2013/32/EU of the European Parliament and of the Council is, according to the latest available updated quarterly Union-wide average Eurostat data, 75 % or higher.
