Notes that when the Lisbon Treaty established the European Council as an institution its tasks were defined in Article 15 TEU as ‘to provide the Union with the necessary impetus for its development and to define the general political directions and priorities’, explicitly excluding the exercise of legislative functions; points out that the European Council has intervened in the legislative procedure by deciding to remove specific elements from texts already agreed by Parliament and the Council; recalls in this connection the de facto deletion of Articles 6 to 8 of the agreed text on the proposal for a regulation on a European patent with unitary effect and considers such interventions by the European Council to be illegitimate;
5. relève que lorsque le traité de Lisbonne a établi le Conseil européen en tant qu'institution, les tâches de ce dernier ont été définies à l'article 15 du traité sur l'Union européenne pour que celui-ci "donne à l'Union les impulsions nécessaires à son développement et en défini[sse] les orientations et les priorités politiques générales", en excluant explicitement l'exercice de fonctions législatives; souligne que le Conseil européen est intervenu dans la procédure législative en décidant de retirer certains éléments de textes déjà convenus entre le Parlement et le Conseil; rappelle à cet égard la suppression de fait des articles 6 à 8 du texte convenu sur la proposition de règlement sur un brevet européen à effet unitaire et juge illégitimes ces interventions du Conseil européen;

The new elements introduced by the Council in the proposal for a regulation include the rewording of Article 2 on the duties of the agency which makes the text clearer without altering its content, a reference to transparency and the protection of information, the removal of the reference to the seat of the agency, not that this will stop me from referring to it, the special adoption procedure for the work programme in the event of disagreement by the Commission, the representation of all the Member States on the administrative board and the participation of professionals not representative of branches without the right to vote, the power of the administrative board to examine specific issues without the presence of its professional members and the possibility of appointing or dismissing the executive director by a special majority of four-fifths of members.
Parmi les nouveaux éléments introduits par le Conseil dans la proposition de règlement, il convient de souligner notamment : la reformulation de l’article 2 relatif aux tâches de l’Agence et qui, sans en modifier la substance, contribue à le rendre plus clair, la référence à la transparence et à la protection des informations, la suppression de la référence au siège de l’Agence - mais je vais en tout cas l’évoquer -, la mise en place d’une procédure spéciale pour l’adoption du programme de travail en cas de désaccord de la Commission, la représentation de tous les États membres au sein du conseil d’administration, et la participation de professionnels - et non de représentants des secteurs - sans droit de vote, la possibilité pour le conseil d’administration d’examiner certaines questions sans la présence de ses membres professionnels, la nomination ou la révocation du directeur exécutif à la majorité qualifiée des quatre cinquièmes des membres.
