2. By way of derogation from Article 8(1) of Council Regulation (EC) No 297/95 of 10 February 1995 on fees payable to the European Agency for the Evaluation of Medicinal Products , a 90 % reduction for small and medium-sized enterprises and 65 % for other applicants shall apply to the fee for scientific advice payable to the Agency for any advice given in respect of advanced therapy medicinal products pursuant to paragraph 1 of this Article and Article 57(1)(n) of Regulation (EC) No 726/2004.
2. Any rule of the Host State which made it more difficult for a litigant to receive legal aid in respect of advice given by an "out of State" lawyer than a local lawyer could equally constitute disguised discrimination both against the litigant (in respect of his freedom to receive services) and the lawyer (in respect of his freedom to provide services) [7].

What we are suggesting in the amendment is that where the advisory panel gives advice to the minister under subsection (2) and the minister decides not to accept that advice in exercising any power under this act in respect of the subject matter of that advice, the minister shall without delay provide the advisory panel and the taxing authority in respect of whom the advice was given with written reasons for that decision.

25) "Tied agent" means a natural or legal person who, under the full and unconditional responsibility of only one investment firm on whose behalf it acts, promotes investment and/or ancillary services to clients or prospective clients, receives and transmits instructions or orders from the client in respect of investment services or financial instruments, places financial instruments and/or provides advice to clients or prospective clients in respect of those financial instruments or services.
