TRADUCTIONS EN CONTEXTE

As regards Regulation (EC) No 1528/2007, in order to make technical adaptations to the arrangements for products originating in certain states part of the African, Caribbean and Pacific (ACP) Group of States, the power to adopt acts in accordance with Article 290 of the Treaty on the Functioning of the European Union should be delegated to the Commission in respect of amending Annex I to that Regulation in order to add or to remove regions or states, and in respect of introducing technical amendments to Annex II to that Regulation that are necessary as a result of the application of that Annex.
En ce qui concerne le règlement (CE) no 1528/2007, afin de permettre l'application des adaptations techniques des régimes prévus aux produits originaires de certains États appartenant au groupe des États d'Afrique, des Caraïbes et du Pacifique (ACP), il convient de déléguer à la Commission le pouvoir d'adopter des actes conformément à l'article 290 du traité sur le fonctionnement de l'Union européenne en vue de la modification de l'annexe I dudit règlement afin d'y ajouter ou d'en retirer des régions ou des États, et en vue de l'introduction de modifications techniques à l'annexe II de ce règlement, rendues nécessaires par l'application de ladite annexe.

The power to adopt acts in accordance with Article 290 TFEU should be delegated to the Commission in respect of the adaptation of the indicators set out in Annex II in order to take into account changes in the legislative framework in the area of consumer protection, and in respect of amending Annex I by removing specific actions concerned in order to take into account the results of an evaluation report by the Commission.

In order to supplement or amend certain non-essential elements of Regulation (EC) No 1217/2009, the power to adopt acts in accordance with Article 290 of the Treaty should be delegated to the Commission in respect of amending Annex I with respect to Farm Accountancy Data Network (FADN) divisions per Member State, laying down the rules for fixing the threshold for the economic size of returning holdings and the rules for establishing the plan for the selection of returning holdings, fixing the reference period for the standard output, defining the general and principal types of farming, specifying the main groups of accountancy data to be collected and adopting general rules on the accountancy data to be included in the farm return.

However, the exception applies only in respect of amendments made prior to the coming into force of Bill S-202 since it is presumed that once Bill S-202 would apply, it might be tempting to resort to minor technical amendments to reset the clock and avoid a difficult debate in respect of controversial provisions.

4. The proposal, adoption and entry into force of amendments to Annex A, B or C shall be subject to the same procedures as for the proposal, adoption and entry into force of additional Annexes to this Convention, except that an amendment to Annex A, B or C shall not enter into force with respect to any Party that has made a declaration with respect to amendment to those Annexes in accordance with paragraph 4 of Article 25, in which case any such amendment shall enter into force for such a Party on the 90th day after the date of deposit with the depository of its instrument of ratification, acceptance, approval or accession with respect to such amendment.
4. With effect from 1 January 2007, with respect to two- or three- wheel vehicles which comply with the provisions laid down in Directives 93/14/EEC, 93/34/EC, 95/1/EC, and 97/24/EC respectively, as amended by this Directive, Member States shall not, on grounds relating to the subject matter of the Directive concerned, refuse to grant EC type-approval or prohibit the registration, sale or entry into service of such a vehicle.

During its comprehensive review, the committee considered 19 recommendations for amendment and, consistent with the principles with respect to amendments and to be consistent with the principles of the bill and within federal jurisdiction, accepted two of those amendments.

Therefore, in a spirit of cooperation and in order to ensure swift passage of Bill C-10B, your Committee appreciates the agreement of the House of Commons on amendments 1 and 5 and it accepts, with modification, amendment 4. With respect to amendment 2, your Committee has insisted on its original amendment because it remains convinced that this amendment offers better protection to individuals engaged in generally accepted practices involving animals, as referred to above.
