Urges, in cases where there is no evidence of fraud but where serious deficiencies in management and control systems have been identified, that the Commission only interrupt or suspend payments as a last resort, when all other options have been exhausted, because suspending payments could have serious consequences for the respective programmes and regions severely hit by the crisis, as well as for the achievement of cohesion policy goals as a whole; requests, however, that the Commission make an assessment before taking a decision on the suspension of payments as to what extent it shall really contribute to reducing the error rate and at the same time, how it will affect the respective region or country, in order also to avoid imposing burdens on regions suffering from socioeconomic difficulties;

(a) In the case of the Hong Kong Special Administrative Region, subject to the provisions of the laws of the Hong Kong Special Administrative Region relating to the allowance of a credit against Hong Kong Special Administrative Region tax of tax paid in a jurisdiction outside the Hong Kong Special Administrative Region (which shall not affect the general principle of this Article), Canadian tax paid under the laws of Canada and in accordance with this Agreement, whether directly or by deduction, in respect of income derived by a person who is a resident of the Hong Kong Special Administrative Region from sources in Canada, shall be allowed as a credit against Hong Kong Special Administrative Region tax payable in respect of that income, provided that the credit so allowed does not exceed the amount of Hong Kong Special Administrative Region tax computed in respect of that income in accordance with the tax laws of the Hong Kong Special Administrative Region.

(17) If, on any day after March 12, 2011, the required number of hours of insurable employment in a claimant’s qualifying period and the number of weeks for which benefits are payable, determined in respect of Lower St. Lawrence and North Shore using the regional rate of unemployment as determined in accordance with subsection (12), are exactly the same as if they were determined in respect of the same region using the regional rate of unemployment as determined in accordance with subsection 17(1), subsections (12) and (13) cease to have effect on the Sunday after that day.

This becomes obvious when the objectives of the park's creation are examined. They are: to protect the Bluenose caribou herd and its calving and post-calving habitat; to protect in perpetuity a natural area in the Tundra Hills region, and encourage the public to understand and appreciate the region in such a way as to leave it intact for coming generations; to encourage collaboration between the Inuvialuit, the Government of Canada and the Government of the Northwest Territories with respect to the planning, operation and management of the park; to encourage and support the creation and maintaining of jobs and businesses in the region, by encouraging subsistence use of the park; to encourage greater understanding and respect of the cultural heritage of the Inuvialuit and their natural environment; to create an environment suited to long-term research into its ecological and cultural heritage; and to preserve the ecological integrity of the park.

1.14 considers that the fuller recognition of the local and regional dimension within the new architecture of the Union will both improve its effectiveness and its linkages with citizens: European integration should entail political decision-making where account is taken of the views of local and regional authorities, as it is these spheres of governance that are responsible for the transposition and implementation of a large proportion of EU legislation and policy, and are closest to the citizen so can therefore contribute substantially to the quality of Union legislation; [Article I-5] however states that consultation cannot substitute responsibility and accountability of regions and local authorities within their respective spheres of competence which have to be respected; they must be given the chance to prove that they can, according to the internal provisions of the respective Member State, sufficiently achieve the objectives of the intended action;

– having regard to Article 3(3), fourth subparagraph, of the Draft Treaty establishing a Constitution for Europe, affirming that the Union shall respect its rich cultural and linguistic diversity, and shall ensure that Europe's cultural heritage is safeguarded and enhanced; to Article II-22, affirming that the Union shall respect cultural, religious and linguistic diversity; to Article III-181(1), reaffirming that the Union shall contribute to the flowering of the cultures of the Members States, while respecting their national and regional diversity and at the same time bringing the common cultural heritage to the fore, and paragraph 4, reaffirming that the Union shall take cultural aspects into account in its action under other provisions of the Constitution, in particular in order to respect and to promote the diversity of its cultures; to Article III-182(1), reaffirming that it shall fully respect the cultural and linguistic diversity of the educational systems of the Member States; to Article III-217(4), affirming the unanimity rule in the Council when negotiating and concluding agreements in the field of trade in cultural and audiovisual services, where these risk prejudicing the Union's cultural and linguistic diversity,
