Nothing in this Regulation should prevent a competent authority from requiring an operator to transfer a number of allowances, received in excess of its adjusted allocation for the relevant year, to the EU Allocation Account in cases where there has been an over allocation of allowances, including as a result of an error in the original allocation or the operator having failed to correctly or completely submit to the competent authority information pursuant to Article 24 of Decision 2011/278/EU by the date set out in that Article, provided that the central administrator has made a change to the national allocation table of the Member State pursuant to Article 52(2) of this Regulation to adjust the allocation accordingly.

The auction platforms appointed pursuant to Article 26(1) or (2) of this Regulation shall make their determinations and publications as provided in paragraph 1 of this Article in accordance with Annex I and the Commission’s determination and publication of the estimated amount of allowances to be auctioned or the most recent amendment of the Commission’s original estimate, including any adjustment, referred to in Article 10(3)’.

Member States shall allow a regulated market to adjust its fees for cancelled orders according to the length of time for which the order was maintained and to calibrate the fees to each financial instrument to which they apply.

2. Member States may allow commitments under Articles 28, 29, 33 and 34 of Regulation (EU) No 1305/2013 to be adjusted during the period for which they apply, provided that the approved rural development programme provides the possibility for such adjustment and that the adjustment is duly justified having regard to the achievement of the objectives of the original commitment.

Les États membres peuvent prévoir la possibilité d’adapter les engagements au titre des articles 28, 29, 33 et 34 du règlement (UE) no 1305/2013 au cours de la période de leur exécution, à condition que le programme de développement rural approuvé prévoie une telle possibilité et que l’adaptation soit dûment justifiée, compte tenu des objectifs de l’engagement initial.

In respect of Member States applying Article 10c of the Directive and without prejudice to the first sentence of Article 10c(2) of the Directive, the total quantity of allowances to be auctioned in a given year following the adjustment set out in the second column of the table in Annex IV to this Regulation shall not be lower than the quantity of allowances to be transitionally allocated free of charge to installations for electricity production in that same year.
Pour les États membres appliquant les dispositions de l’article 10 quater de la directive et sans préjudice de la première phrase de l’article 10 quater, paragraphe 2, de celle-ci, la quantité totale de quotas à mettre aux enchères une année donnée après l’ajustement indiqué dans la deuxième colonne du tableau figurant à l’annexe IV du présent règlement n’est pas inférieure à la quantité de quotas à allouer de façon transitoire à titre gratuit, cette même année, aux installations de production d’électricité.
