We are seeing something new in international humanitarian rights with Kosovo, where, for perhaps the first time, humanitarian rights, or the right to carry out humanitarian interventions, have taken precedence over State sovereignty.

Reiterates its commitment to the principle of the ‘Responsibility to Protect’ (R2P), stressing the importance that the international community, including the EU, assumes responsibility for addressing gross human rights violations in third countries when the governments of these countries are unable or unwilling to protect their own citizens; stresses that this action of the international community implies humanitarian intervention and appropriate diplomatic pressure and, only as a last resort, the collective use of force, under the auspices or authorisation of the UN; urges the EU to actively engage and promote the urgent reform of the UN Security Council, so as to avoid the obstruction of R2P;

− (PT) As we pointed out previously, we cannot support the ‘consensus’ on the EU's principles, objectives and strategies for the delivery of humanitarian aid in third countries, which requires us to promote so-called ‘humanitarian’ intervention as a ‘right’ or indeed a ‘duty’, and to use ‘coercive measures, including military intervention’, as a ‘last resort’, calling into question basic principles of international law.
− (PT) Comme nous l'avons indiqué précédemment, nous ne pouvons pas nous associer à un «consensus» sur les principes, les objectifs et la stratégie de l'UE pour la fourniture d'aide humanitaire aux pays tiers, qui nous demande de promouvoir l'intervention dite «humanitaire» comme un «droit» ou même un «devoir» et de recourir «en dernier recours» à des «mesures coercitives, y compris l'intervention militaire», au mépris des principes fondamentaux du droit international.

The basis for humanitarian intervention in Sudan and in countries where gross human rights abuses have taken place, such as in Rwanda, Kosovo, and Afghanistan, should come, I believe, from the concept of the responsibility to protect, a concept supported by the Canadian government, a concept that involves a rethinking of the traditional notion of state sovereignty, a concept that advances the idea that states are responsible for the protection and security of their own citizens, a concept that also advances the principle that when states cannot or will not ensure the protection and security of their citizens, the traditional principle of non-intervention in state affairs should yield to the responsibility of the international community to act, preferably with the blessing of the United Nations Security Council, but without this blessing if it not forthcoming.
Les interventions humanitaires au Soudan et dans les pays où il y a eu de graves violations des droits de la personne comme au Rwanda, au Kosovo et en Afghanistan devraient, selon moi, reposer sur le principe de la responsabilité de protéger, un principe auquel souscrit le gouvernement canadien et qui oblige à repenser la notion traditionnelle de la souveraineté des États. Selon ce principe, les États ont la responsabilité de protéger leurs propres citoyens et d'assurer leur sécurité, et lorsqu'ils ne peuvent pas ou ne veulent pas assurer cette protection et cette sécurité, le principe traditionnel de la non-intervention dans les affaires d'un État doit céder le pas devant la responsabilité que la communauté internationale a d'agir, de préférence avec la bénédiction du Conseil de sécurité des Nations Unies, mais sans cette bénédiction si elle ne vient pas.

Considers that preference should be given to the NGO system and the associations of civil society which promote human rights and efforts towards a lasting peace when partners are chosen to carry out humanitarian intervention tasks, since these organisations have proved to be efficient and effective;

Moreover, Canada's Minister of Foreign Affairs, the Honourable Lloyd Axworthy, has acknowledged that Canada was, or would be, in favour of a right of humanitarian intervention.

We have been considering, over the course of recent months and years, Article 6 of the Treaty of Amsterdam, the reaffirmation of the importance and role in the European Union of the principles of freedom, democracy and respect for human rights, and also the creation of the International Criminal Court and the need we all feel to give greater authority to Article 7 of the UN Charter in order to guarantee respect for human rights, eliminating any humanitarian intervention from rationales which are not based purely and simply on respect for these rights: all of this tells us that a great deal of progress has been made.
Prenons, pour ce qui est de ces derniers mois, de ces dernières années, l'article 6 du traité d'Amsterdam, la confirmation du poids et du rôle de l'Union européenne s'agissant des principes de liberté, de démocratie, de respect des droits de l'homme, ou encore la constitution du Tribunal pénal international. Prenons aussi ce besoin que nous ressentons tous de donner plus de force à l'article 7 de la Charte de l'ONU de façon à pouvoir garantir le respect des droits de l'homme, soustrayant l'exercice des éventuelles ingérences humanitaires à des logiques qui ne soient pas liées au seul respect de ces droits.
