Notes that prosecuting terrorist acts carried out in third countries by European citizens or by non-EU nationals residing in the EU requires that the collection of evidence in third countries should be possible, on a basis of full compliance with human rights; calls, therefore for the EU to work on the setting-up of judicial and law enforcement cooperation agreements with third countries to facilitate the collection of evidence in said countries, provided that strict legal standards and procedures, the rule of law, international law and fundamental rights are safeguarded by all parties and under judicial control; recalls, therefore, that the collection of evidence, interrogation and other such investigative techniques must be carried out subject to strict legal standards and must comply with EU laws, principles and values and international human rights standards; warns, in this connection, that the use of cruel, inhuman and degrading treatment, torture, extra-judicial renditions and kidnapping is prohibited under international law and may not take place for the purpose of collecting evidence of criminal offences committed inside the territory of the EU or outside its territory by EU nationals;

This Regulation respects the fundamental rights and observes the principles recognised in particular by the Charter of Fundamental Rights of the European Union, in particular the right to the protection of personal data (Article 8), the freedom to conduct a business (Article 16), the right to consumer protection (Article 38), the right to an effective remedy and to a fair trial (Article 47), and the right not to be tried or punished twice for the same offence (Article 50), and has to be applied in accordance with those rights and principles.

(13a) However, in order to allow the beneficiaries to enjoy in another Member State the rights which have been created or transferred to them, for example in the context of a dispute concerning a matrimonial property regime, this Regulation should provide for the adaptation of an unknown right in rem to the closest equivalent right in rem under the law of that other Member State. In the context of such an adaptation, account should be taken of the aims and the interests pursued by the specific right in rem and the effects attached to it. For the purposes of determining the closest equivalent national right in rem, the authorities or competent persons of the State whose law applies to the matrimonial property regime may be contacted for further information on the nature and the effects of the right. To that end, the existing networks in the area of judicial cooperation in civil and commercial matters could be used as well as any other available means facilitating the understanding of foreign law (Corresponds to recital 16 in Regulation (EU) No 650/2012.)
(13 bis) Toutefois, afin de permettre aux bénéficiaires de jouir dans un autre État membre des droits qui ont été créés ou leur ont été transférés, par exemple dans le cadre d'un litige relatif à un régime matrimonial, il convient que le présent règlement prévoie l'adaptation d'un droit réel inconnu à son équivalent le plus proche en vertu du droit de cet autre État membre. Dans le cadre de cette adaptation, il y a lieu de tenir compte des objectifs et des intérêts poursuivis par le droit réel en question et des effets qui y sont liés. Pour déterminer l'équivalent le plus proche du droit réel en droit national, les autorités ou les personnes compétentes de l'État dont la loi s'applique au régime matrimonial pourront être contactées afin d'obtenir des informations complémentaires sur la nature et les effets de ce droit. À cette fin, il serait possible d'avoir recours aux réseaux existants dans le domaine de la coopération judiciaire en matière civile et commerciale, ainsi qu'à tout autre moyen disponible permettant de comprendre plus facilement la loi étrangère (Correspond au considérant 16 du règlement (UE) n° 650/2012)

D. whereas the EU strongly advocates for a stable and democratic Ukraine that respects the principles of a social and inclusive market economy, the rule of law (including an independent judiciary), human rights and the protection of minorities, and which guarantees fundamental rights; whereas Ukraine's efforts to build domestic political stability, to create an environment characterised by robust political pluralism, democratic freedoms and respect for the rule of law, and to step up internal reform, are accelerating and facilitating the further development of Ukraine's European perspective;

This Regulation respects the fundamental rights and observes the principles recognised by Articles 2 and 6 of the Treaty on European Union (TEU) and by the Charter, in particular respect for human dignity, the right to life, the prohibition of torture and of inhuman or degrading treatment or punishment, the prohibition of trafficking in human beings, the right to liberty and security, the right to the protection of personal data, the right to asylum and to protection against removal and expulsion, the principles of non-refoulement and non-discrimination, the right to an effective remedy and the rights of the child.

Welcomes the statements by the UN High Commissioner for Human Rights on her first visit to the occupied Palestinian territory and Israel and, in particular, the strong message that she conveyed with her criticism of Israeli settlement policy, and that ‘international human rights law and international humanitarian law are not negotiable’; underlines the importance of a peaceful democratisation of the Middle East;

This Directive respects fundamental rights and observes the principles recognised in particular by the Charter of Fundamental Rights of the European Union and in particular the right to the protection of human dignity, the prohibition of torture and inhuman or degrading treatment or punishment, the rights of the child, the right to liberty and security, the right to freedom of expression and information, the right to the protection of personal data, the right to an effective remedy and to a fair trial and the principles of legality and proportionality of criminal offences and penalties.
