European Commission First Vice-President Frans Timmermans and Council of Europe Secretary General Thorbjørn Jagland issued this joint statement today, ahead of Human Rights Day on Sunday 10 December, calling on governments and opposition politicians across Europe to recommit to promoting and maintaining human rights standards.

2. On request, the Commission may grant a compulsory licence in respect of a first patent to the proprietor of a national or Community patent or to the proprietor of a plant variety right who cannot use his patent (second patent) or his national or Community plant variety right without infringing a Community patent (first patent), provided that the invention or new plant variety claimed in the second patent or plant variety right involves an important technical advance of considerable economic significance in relation to the invention claimed in the first patent.
2. La Commission peut accorder au titulaire d'un brevet national ou communautaire ou au titulaire d'un droit d'obtention végétale qui ne peut pas exploiter son brevet (second brevet) ou son droit d'obtention végétale national ou communautaire sans porter atteinte à un brevet communautaire (premier brevet), sur demande, une licence obligatoire sur le premier brevet, à condition que l'invention ou l'obtention végétale revendiquée dans le second brevet ou le droit d'obtention végétale suppose un progrès technique important, d'un intérêt économique considérable, par rapport à l'invention revendiquée dans le premier brevet.

Urges the Council and the Commission to set up human rights subcommittees with all neighbourhood countries; reiterates its call for parliamentarians to be associated with the preparations for meetings of such subcommittees and to be informed of their outcome; is of the view that, while first rounds of meetings, as was the case with Tunisia, might focus on establishing the durability of the subcommittee and fostering trust and confidence among partners, such subcommittees, notably with Morocco now, should move towards a result-oriented phase, with the establishment of concrete benchmarks and indicators of progress, as well as the possibility of raising individual cases; stresses that discussions on human rights should certainly not be confined to these subcommittees, and highlights the need to include these issues in the political dialogue up to the highest level so as to increase the coherence of the EU's policy in this field and reduce discrepancies in statements on the human rights situation given by both sides to the press; welcomes the Council's statement of 16 October 2007 that discussions concerning a future EU-Libya framework agreement will specifically address, inter alia, cooperation and progress on human rights;
demande au Conseil et à la Commission de mettre en place des sous-commissions des Droits de l'homme avec tous les pays voisins; réitère son appel pour que des parlementaires soient associés à la préparation des réunions de ces sous-commissions, et soient informés de leurs résultats; est d'avis que ces sous-commissions, si elles pouvaient consacrer leurs premières séries de réunions, comme ce fut le cas avec la Tunisie ou l'Égypte, à fixer durablement leur assise et à faire naître estime et confiance entre leurs membres, devraient ensuite évoluer — particulièrement, dorénavant, dans le cas du Maroc — vers une phase orientée vers les résultats, par l'établissement de références concrètes et d'indicateurs de progrès, ainsi que par la possibilité de soulever des cas individuels; rappelle que les discussions en matière de Droits de l'homme ne doivent en aucun cas être confinées à ces sous-commissions et souligne à cet égard la nécessité d'inclure ces questions dans le cadre du dialogue politique jusqu'au plus haut niveau de manière à augmenter la cohérence de la politique de l'Union en la matière et de réduire les dissonances dans les déclarations sur la situation en matière de Droits de l'homme faites à la presse par les deux parties; se félicite de la déclaration du Conseil du 16 octobre 2007 selon laquelle les négociations sur un futur accord-cadre entre l'UE et la Lybie porteront, entre autres, sur la coopération en matière de Droits de l'homme et sur les progrès à réaliser dans ce domaine;

Moreover, the appellant was in a position to challenge before the Court of First Instance the Board of Appeal’s assertion that the sweet wrapper at issue is not significantly different from numerous other wrappers commonly used in the confectionery market. Accordingly, its rights of defence, and particularly its right to be heard, were observed before that court.
