6. Notes that these developments have led to concerns regarding the principles of the rule of law, democracy and fundamental rights in Hungary over the past years, which, taken together, could represent an emerging systemic threat to the rule of law in this Member State; is of the opinion, contrary to the statement made by the Commission before Parliament on 2 December 2015, that the conditions for the activation of the rule of law framework and Article 7(1) are fully met; believes that Hungary presents a test for the EU to prove its capacity and willingness to react to threats to and breaches of its own founding values by a Member State; notes with concern that developments in some other Member States show worrying signs of an undermining of the rule of law similar to that in Hungary; regrets that the Commission’s continued lack of political willingness to address properly the situation in Hungary is creating a precedent with regard to other Member States that are adopting similar worrying trends concerning respect for the rule of law; believes that this raises serious concerns as to the ability of the Union to ensure continuing respect for the political Copenhagen criteria once a Member State has acceded to the Union;
6. relève que ces événements ont suscité des inquiétudes au sujet des principes de l'état de droit, de la démocratie et des droits fondamentaux en Hongrie au cours des dernières années, qui, au total, pourraient constituer l'émergence d'une menace systémique pour l'état de droit dans cet État membre; estime que, contrairement à la déclaration faite par la Commission devant le Parlement le 2 décembre 2015, les conditions pour l'activation du cadre de l'état de droit et pour l'application de l'article 7, paragraphe 1, sont pleinement réunies; estime que la Hongrie permet de tester la capacité et la volonté de l'Union de réagir aux menaces et aux violations de ses propres valeurs fondamentales par un État membre; note avec inquiétude que certaines évolutions dans d'autres États membres montrent des tendances similaires au non-respect de l'état de droit observé en Hongrie; déplore que le manque de volonté politique persistant de la Commission à remédier comme il se doit à la situation en Hongrie crée un précédent pour d'autres États membres qui affichent de telles tendances préoccupantes en matière de respect de l'état de droit; estime que cela soulève de sérieuses questions quant à la capacité de l'Union d'assurer le respect continu des critères politiques de Copenhague après l'adhésion d'un État membre à l'Union;

H. whereas the Commission failed to respond to Parliament’s request to undertake an in‑depth monitoring process on the situation of democracy, the rule of law and fundamental rights in Hungary; whereas in its statement presented at the plenary debate held in the European Parliament on 2 December 2015 the Commission declared that it was ready to use all the means at its disposal, including infringement proceedings, to ensure that Hungary – and any other Member State – complies with its obligations under EU law and respects the values of the Union as enshrined in Article 2 TEU; whereas the Commission considers that the conditions to activate the Rule of Law Framework regarding Hungary are at this stage not met;
H. considérant que la Commission a omis de donner suite à la demande du Parlement d'engager un processus d'évaluation approfondie de la situation de la démocratie, de l'état de droit et des droits fondamentaux en Hongrie; considérant que la Commission a, lors des débats du 2 décembre 2015 du Parlement européen, déclaré, en séance plénière, qu'elle était prête à utiliser tous les moyens à sa disposition, notamment une procédure d'infraction, pour veiller à ce que la Hongrie – ou tout autre État membre – se conforme aux obligations qui sont les siennes en vertu du droit de l'Union et respecte les valeurs de l'Union consacrées par l'article 2 du traité UE; considérant que la Commission estime que les conditions pour activer le cadre de l'état de droit en ce qui concerne la Hongrie ne sont pas réunies à ce stade;

Notes that these developments have given rise to concern over the principles of the rule of law, democracy and fundamental rights in Hungary in recent years, which, taking things together, could point to an emerging systemic threat to the rule of law in this Member State; believes that Hungary is combining violations of rights occurring in other Member states and is as such a test for the EU to prove its capacity and willingness to react to threats and breaches of its own founding values by a Member State; notes with concern that developments in some other Member States, such as Poland, France, Slovakia and the Czech Republic show worrying signs of similar undermining of the rule of law;
5. relève que ces événements ont suscité des inquiétudes au sujet des principes de l'état de droit, de la démocratie et des droits de l'homme en Hongrie ces dernières années, ce qui, au total, pourrait être le signe de l'émergence d'une menace systémique pour l'état de droit dans cet État membre; estime que la Hongrie, qui cumule les violations des droits auxquelles on assiste dans d'autres États membres, constitue à ce titre un test de la capacité et de la volonté de l'Union de réagir aux menaces et aux violations de ses propres valeurs fondamentales par un État membre; note avec inquiétude que les évolutions dans certains autres États membres, notamment en Pologne, en France, en Slovaquie et en République tchèque, montrent des signes inquiétants d'une érosion semblable de l'état de droit;

Notes that the constitutional, legal and political developments have given rise to concerns regarding the principles of the rule of law, democracy and fundamental rights in Hungary in recent years, and that these developments, taken together, clearly represent an emerging systemic threat to the rule of law in this Member State; believes that Hungary is a test for the EU to prove its capacity and willingness to react to threats to and breaches of its own founding values by a Member State; regrets that the inaction of the EU may have contributed to similar developments in some other Member States, such as Poland, where thare are worrying signs, similar to those in Hungary, of the rule of law being undermined;
6. relève que les événements sur le plan constitutionnel, juridique et politique ont suscité des inquiétudes au sujet des principes de l'état de droit, de la démocratie et des droits fondamentaux en Hongrie ces dernières années et que ces événements, pris ensemble, attestent l'émergence d'une menace systémique pour l'état de droit dans cet État membre; estime que la Hongrie permet de tester la capacité et la volonté de l'Union de réagir aux menaces et aux violations de ses propres valeurs fondamentales par un État membre; regrette que l'inaction de l'Union ait potentiellement contribué à l'apparition de phénomènes similaires dans d'autres États membres, comme la Pologne, où ont été constatés des signes inquiétants d'atteinte à l'état de droit comparables à ceux qui existent en Hongrie;

11. Urges the Commission to activate the first stage of the EU framework to strengthen the rule of law, and therefore to initiate immediately an in-depth monitoring process concerning the situation of democracy, the rule of law and fundamental rights in Hungary, assessing a potential systemic serious breach of the values on which the Union is founded as per Article 2 TEU, including the combined impact of a number of measures exacerbating the state of democracy, the rule of law and fundamental rights, and evaluating the emergence of a systemic threat to the rule of law in that Member State that could develop into a clear risk of a serious breach within the meaning of Article 7 TEU; asks the Commission to report back on this matter to Parliament and the Council before September 2015;
11. prie instamment la Commission d'activer la première phase du cadre de l'Union pour renforcer l'état de droit et dès lors d'enclencher immédiatement un processus de surveillance approfondie de la situation en matière de démocratie, d'état de droit et de droits fondamentaux en Hongrie, évaluant une possible violation systémique grave des valeurs sur lesquelles l'Union est fondée, conformément à l'article 2 du traité UE, y compris l'effet combiné d'une série de mesures aggravant la situation en matière de démocratie, d'état de droit et de droits fondamentaux, et évaluant l'émergence d'une menace systémique pour l'état de droit dans cet État membre qui pourrait donner lieu à un risque évident de violation grave au sens de l'article 7 du traité UE; demande à la Commission de rendre compte de la situation au Parlement et au Conseil pour le mois de septembre 2015;

In addition to these concerns, the Commission is also of the opinion that Hungary violates the right to freedom of association and the rights to protection of private life and personal data enshrined in the Charter of Fundamental Rights of the European Union, read in conjunction with the EU Treaty provisions on the free movement of capital.

Among Member States which apply a prohibition on use of temporary agency workers to replace workers exercising their right to strike (Austria, Belgium, Bulgaria, Croatia, France, Greece, Hungary, Italy, Poland, Slovenia, Spain), four (Belgium, Greece, Hungary and Italy) have explicitly referred to the protection of the right to strike.
