As regards the proviso that only enterprises established in Sachsen-Anhalt should benefit from the scheme, Germany informed the Commission that the authorising committee had also chosen two companies established in Lower Saxony and North Rhine-Westphalia which only had branches in Sachsen-Anhalt.

On 9 October 1996 the Commission decided to initiate the procedure pursuant to Article 93(2) of the EC Treaty with regard to an aid programme of the German Federal State Sachsen-Anhalt together with the Bürgschaftsbank Sachsen-Anhalt GmbH (hereinafter referred to as 'the guarantee bank`).
Le 9 octobre 1996, la Commission a décidé d'ouvrir la procédure prévue à l'article 93, paragraphe 2, du traité CE à l'égard d'un programme d'aides mis en oeuvre en commun par le Land de Saxe-Anhalt et la Bürgschaftsbank Sachsen-Anhalt GmbH (ci-après dénommée «la Bürgschaftsbank»).

The guarantee bank granted deficiency guarantees backed by the counter-guarantee of the Land Sachsen-Anhalt for altogether 39 companies, to a value of between DEM 18 000 and DEM 1,8 million.
La Bürgschaftsbank a offert des garanties de bonne fin couvertes par la contre-garantie du Land de Saxe-Anhalt d'une valeur comprise entre 18 000 et 1,8 million de marks allemands, à 39 entreprises au total.

The guarantees granted by the guarantee bank under its Sonderbürgerschaftsprogramm Liquiditässicherung constitute State aid within the meaning of Articles 92(1) of the EC Treaty and 61(1) of the EEA Agreement. This is so because the guarantees were 90 % covered by the counter-guarantee of Sachsen-Anhalt and had been approved in collaboration with State officials.
Les garanties que la Bürgschaftsbank a offertes dans le cadre de son programme spécial de garanties visant à assurer les liquidités des entreprises constituent des aides d'État au sens de l'article 92, paragraphe 1, du traité CE et de l'article 61, paragraphe 1, de l'accord EEE, car elles étaient couvertes à 90 % par une contre-garantie du Land de Saxe-Anhalt et ont été accordées avec le concours des pouvoirs publics.

In order to maintain the operations on short term during the stage of sequestration, as well as to secure the company`s financial assets, especially abroad, the government of the Land Sachsen-Anhalt decided to grant the following contributions: - DM 770,000 for the purchase of material to work-off existing orders by customers, and for the release of material being under reservation of proprietary rights, both aimed for Samag's divisions excluding the cast iron foundry, - DM 230,000 for the foundry, thereof DM 162,000 for the coverage of personnel costs, DM 43,000 for overhead expenses and DM 25,000 for other expenses - DM 600,000 for the repatriation of Samag's financial assets from abroad (also for appropriate measures to secure assets abroad), - DM 50,000 for social security payments, - DM 350,000 for payments to public utilities (gas, water, electricity).
Pour permettre à l'entreprise de poursuivre ses activités à court terme au cours de la procédure et pour préserver ses actifs financiers, en particulier les actifs étrangers, le gouvernement du Land de Saxe-Anhalt a décidé de lui accorder les aides suivantes: - 770 000 DM pour l'achat de matériel destiné à achever les commandes en cours, ainsi que pour la libération de matériel bloqué en raison d'une clause de réserve de propriété; le matériel en question est destiné, dans les deux cas, aux différentes divisions de Samag, à l'exception de la fonderie de fonte; - 230 000 DM pour la fonderie, ventilés comme suit: 162 000 DM pour les coûts de main-d'oeuvre, 43 000 DM pour les frais généraux et 25 000 DM pour d'autres frais; - 600 000 DM destinés au rapatriement des actifs financiers détenus par Samag à l'étranger (ainsi qu'à la prise de mesures propres à protéger certains de ces actifs); - 50 000 DM pour les cotisations de sécurité sociale; - 350 000 DM destinés à couvrir les paiements aux services publics (gaz, eau, électricité).
