IN-CONTEXT TRANSLATIONS

A. whereas the Union is bound by the Charter of Fundamental Rights of the European Union (the Charter), including Article 8 thereof on the right to the protection of personal data, and by Article 16 of the Treaty on the Functioning of the European Union (TFEU) on the same fundamental right, as a key pillar of EU primary law which must be fully respected by all international agreements;

Calls on the Commission to extend the remit of the Fundamental Rights Agency to cover all candidate and neighbourhood countries, giving it a specific role in advising EU institutions on how to ensure coherence and consistency between internal and external policies on human rights; calls for the same fundamental rights indicators to be established for all Member States;

This Directive respects the fundamental rights and observes the principles recognised in the Charter of Fundamental Rights of the European Union, notably protection of personal data (Article 8), the freedom to choose an occupation and right to engage in work (Article 15), the freedom to conduct a business (Article 16), the right to collective bargaining and action (Article 28), fair and just working conditions (Article 31), the right to an effective remedy and to a fair trial (Article 47), the presumption of innocence and right of defence (Article 48) and the right not to be tried twice for the same offence (ne bis in idem) (Article 50), and has to be implemented in accordance with those rights and principles.

Reaffirms that the Charter has the same legal value as the Treaties and represents the most modern codification of fundamental rights, offering a good balance between rights and solidarity and encompassing civil, political, economic, social and cultural rights as well as ‘third generation’ rights (i.e. the rights to good administration, freedom of information, a healthy environment and consumer protection); considers that the EU should develop a regulatory framework to protect against fundamental rights abuses by businesses;

I. whereas the coexistence of two parallel legal frameworks in which criminal law sanctions are adopted with reference to the same Member States, the same fundamental rights, the same citizens and the same objective of developing the Union as an area of freedom, security and justice may result in delays, parallel proceedings, possible incoherence and legal uncertainty,
