In taking this decision, the Commission has taken into account the assurances of the German authorities : - that, in general, an increase of slaughter capacities is not planned, but only a replacement of existing capacities and - that, wherever an increase in slaughter capacity in the case of an individual project is envisaged, they will ensure that - at least equal capacity is dismantled in the same or other firms in the same region and within an appropriate period of time (maximum 1 year before or after the planned project is operational), or - the production level in the region i.e. in the "Landkreis" in which the investment project is planned plus surrounding "Landkreise" indicates a shortfall in capacity.
