Without prejudice to the possible application of Article 18 of the basic Regulation, companies that have agreed to their possible inclusion in the sample but are not selected to be in the sample will be considered to be cooperating (‘non-sampled cooperating exporting producers and traders/blenders’).

For the purposes of Article 2(7)(b) of the basic Regulation, the Commission sent MET claim forms to all the cooperating exporting producers in the PRC selected to be in the sample and to non-sampled cooperating exporting producers that wished to apply for an individual examination under Article 17(3) of the basic Regulation, to known association of exporting producers, and to the authorities of the PRC.
Au regard de l'article 2, paragraphe 7, point b), du règlement de base, la Commission a envoyé des formulaires de demande de SEM à tous les producteurs-exportateurs coopérants en Chine retenus dans l'échantillon, aux producteurs-exportateurs ayant coopéré mais non retenus dans l'échantillon qui souhaitaient un examen individuel au titre de l'article 17, paragraphe 3, du règlement de base ainsi qu'aux associations connues de producteurs-exportateurs et aux autorités chinoises.

In order to enable the Commission to decide whether sampling is necessary, and if so, to select a sample, all exporting producers and traders/blenders, or representatives acting on their behalf, including the ones who did not cooperate in the investigation leading to the measures subject to the present review, are hereby requested to make themselves known to the Commission. These parties have to do so within 15 days of the date of publication of this Notice in the Official Journal of the European Union, unless otherwise specified, by providing the Commission with the information on their companies requested in Annex I to this Notice.
Pour permettre à la Commission de décider s’il est nécessaire ou non de procéder par échantillonnage et, dans l’affirmative, de constituer un échantillon, tous les producteurs-exportateurs et négociants/mélangeurs, ou leurs représentants, y compris ceux qui n’ont pas coopéré à l’enquête ayant abouti aux mesures soumises au présent réexamen, sont invités à se faire connaître de la Commission et ce, dans les 15 jours suivant la date de publication du présent avis au Journal officiel de l’Union européenne, sauf indication contraire, en fournissant à la Commission les informations concernant leurs sociétés requises à l’annexe I du présent avis.

4. Where any new exporting producer in the People's Republic of China provides sufficient evidence to the Commission that: (a) it did not export to the Union the product described in paragraph 1 in the period between 1 July 2009 and 30 June 2010 (original investigation period), (b) it is not related to any exporter or producer in the People's Republic of China which is subject to the anti-dumping measures imposed by this Regulation, (c) it has actually exported to the Union the product concerned or it has entered into an irrevocable contractual obligation to export a significant quantity to the Union after the end of the original investigation period, the Commission may amend the Annex I by adding the new exporting producer to the cooperating companies not included in the sample of the original investigation and thus subject to the weighted average duty of not exceeding 56.9 %.
4. Lorsqu'un nouveau producteur-exportateur de la République populaire de Chine fournit à la Commission des éléments de preuve suffisants pour établir: a) qu'il n'a pas exporté vers l'Union le produit décrit au paragraphe 1 au cours de la période comprise entre le 1er juillet 2009 et le 30 juin 2010 (période d'enquête initiale), b) qu'il n'est lié à aucun exportateur ou producteur de la République populaire de Chine soumis aux mesures antidumping instituées par le présent règlement, c) qu'il a effectivement exporté vers l'Union le produit concerné ou qu'il s'est engagé d'une manière irrévocable par contrat à exporter une quantité importante vers l'Union après la fin de la période d'enquête initiale, la Commission peut modifier l'annexe I en ajoutant le nouveau producteur-exportateur aux sociétés ayant coopéré non retenues dans l'échantillon de l'enquête initiale et donc soumises au droit moyen pondéré n'excédant pas 56,9 %.

The exporting producers that had agreed to their possible inclusion in the sample, but were not selected to be in the sample, shall be considered to be cooperating (‘non-sampled cooperating exporting producers’).
Les producteurs-exportateurs qui auront accepté d’être éventuellement inclus dans l’échantillon mais n’auront pas été sélectionnés (ci-après les «producteurs-exportateurs ayant coopéré non retenus dans l’échantillon») seront considérés comme ayant coopéré à l’enquête.

To apply for IT, exporting producers in the People’s Republic of China selected to be in the sample and non-sampled cooperating exporting producers that wish to apply for an individual dumping margin must submit the MET claim form with the sections relevant for IT duly completed within 21 days of the date of the notification of sample selection, unless otherwise specified.

(2) The ruling by the Court of Justice would require that the Commission examine all applications for market economy treatment filed by cooperating exporting producers who are not part of the sample, irrespective of whether the number of cooperating producers is large.
