I would point out that in the Rüffert case, which we are discussing, violation of social standards and the setting of wages at the scandalously low level of 46% took place not as a result of any defects in the Posting of Workers Directive, but simply as a result of the failure to implement part of the relevant legislation of Lower Saxony in the manner envisaged in the Posting of Workers Directive.
