As regards Switzerland, this [INSTRUMENT] constitutes a development of the provisions of the Schengen acquis within the meaning of the Agreement between the European Union, the European Community and the Swiss Confederation on the Swiss Confederation's association with the implementation, application and development of the Schengen acquis*, which fall within the area referred to in Article 1, point [...], of Decision 1999/437/EC read in conjunction with Article 3 of Council Decision 2008/146/EC[**].

IN-CONTEXT TRANSLATIONS

Since the objectives of this Regulation, namely the development and implementation of a system of integrated management of the external borders to ensure the proper functioning of the Schengen area, cannot be sufficiently achieved by the Member States acting in an uncoordinated manner but can rather, by reason of the absence of controls at internal borders, the significant migratory challenges at the external borders, the need to monitor efficiently the crossing of those borders, and to contribute to a high level of internal security within the Union, be better achieved at Union level, the Union may adopt measures, in accordance with the principle of subsidiarity as set out in Article 5 of the TEU.
Étant donné que les objectifs du présent règlement, à savoir le développement et la mise en œuvre d'un système de gestion intégrée des frontières extérieures en vue d'assurer le bon fonctionnement de l'espace Schengen, ne peuvent pas être atteints de manière suffisante par les États membres agissant de manière non coordonnée, mais peuvent, en raison de l'absence de contrôles aux frontières intérieures, des importants défis migratoires aux frontières extérieures, de la nécessité de contrôler efficacement le franchissement de ces frontières et de contribuer à un niveau élevé de sécurité intérieure au sein de l'Union, l'être mieux au niveau de l'Union, celle-ci peut prendre des mesures, conformément au principe de subsidiarité consacré à l'article 5 du traité sur l'Union européenne.

(39)Since the objectives of this Regulation, namely the development and implementation of a system of integrated management of the external borders, thus also ensuring the proper functioning of the Schengen area, cannot be sufficiently achieved by the Member States acting in an uncoordinated manner but can rather, because of the absence of controls at internal borders and in view of the significant migratory pressures at the external borders and the need to safeguard a high level of internal security within the Union, be better achieved at Union level, the Union may adopt measures, in accordance with the principle of subsidiarity as set out in Article of the Treaty on European Union.
(39)Étant donné que les objectifs du présent règlement, à savoir le développement et la mise en œuvre d'un système de gestion intégrée des frontières extérieures, assurant donc également le bon fonctionnement de l'espace Schengen, ne peuvent être suffisamment réalisés par les États membres agissant de manière non coordonnée, mais peuvent en revanche, en raison de l'absence de contrôles aux frontières intérieures et eu égard aux importantes pressions migratoires aux frontières extérieures et à la nécessité de garantir un niveau élevé de sécurité intérieure au sein de l'Union, être mieux réalisés au niveau de l'Union, l'Union pourrait adopter des mesures, conformément au principe de subsidiarité tel qu'établi à l'article 5 du traité sur l'Union européenne.

The fact that internal border controls are temporarily reintroduced cannot affect the length of authorised stay of a third-country national within the Schengen area.
La réintroduction temporaire des contrôles aux frontières ne saurait avoir d’incidence sur la durée du séjour autorisé d’un ressortissant de pays tiers à l'intérieur de l'espace Schengen.

Member States should inform the holders of such documents in an appropriate and efficient way, about the conditions under which they can (or cannot) travel within the Schengen area.
Les États membres devraient informer les titulaires de ces documents, d’une façon appropriée et efficace, des conditions auxquelles ils peuvent (ou ne peuvent pas) voyager dans l’espace Schengen.

4. Urges all Member States to take the decision on enlarging the Schengen area to include Bulgaria and Romania solely on the basis of the Schengen acquis and procedures; believes that additional criteria cannot be imposed on Member States which are already in the process of joining the Schengen area;

However, we cannot invent new criteria for joining the Schengen area and we cannot undermine the certainty that a state is part of that area as soon as current criteria are met.
Cependant, nous ne pouvons pas inventer de nouveaux critères pour rejoindre l’espace Schengen, et nous ne pouvons pas remettre en question le fait qu’un État fait partie de cette zone dès lors qu’il satisfait aux critères actuellement en vigueur.
