As a formal decision of the EIB which is duly published and implemented, a provision governing the scope of the review to be carried out by the EIB’s appeals committee establishes an internal rule of general scope which is legally binding and limits the EIB’s discretion in relation to the organisation of its structures and the management of its staff.

Accordingly, the Commission should entrust a reformed Eurocontrol, which has new governance arrangements in place, with the execution of tasks related to various functions, which do not involve the adoption of binding measures of a general scope or the exercise of political discretion.
