Moreover, the regulation (CE) n° 44/2001, on jurisdiction and the recognition and enforcement of judgements in civil and commercial matters, aims to establish provisions to unify the rules of conflict of jurisdiction in civil and commercial matters and to simplify the formalities for rapid and simple recognition and enforcement of judgements emanating from Member States, addressing inter alia electronic commerce in the context of the internal market.
De plus, le règlement (CE) n° 44/2001 sur la juridiction, la reconnaissance et l'application des jugements dans les domaines civils et commerciaux, tend à mettre en place des dispositions pour unifier les règles de résolution des conflits dans le même domaines et aussi à simplifier les formalités pour une reconnaissance simple et rapide ainsi qu'une application des jugements rendus dans les Etats Membre, s'appliquant inter alia au commerce électronique dans le contexte du marché intérieur.

2. This Regulation shall apply to bilateral agreements between Member States and third countries concerning sectoral matters and covering applicable law in civil and commercial matters, and falling, entirely or partly, within the scope of Regulation (EC) No 593/2008 on the law applicable to contractual obligations and Regulation (EC) No 864/2007 on the law applicable to non-contractual obligations.
2. Le présent règlement est applicable aux accords bilatéraux entre États membres et pays tiers concernant des questions sectorielles et portant sur le droit applicable en matière civile et commerciale, et relevant, entièrement ou partiellement, du champ d’application du règlement (CE) n° 593/2008 sur la loi applicable aux obligations contractuelles et du règlement (CE) n° 864/2007 sur la loi applicable aux obligations non contractuelles.

As you know, the objective of the negotiations was to cover sectors such as services, investments, intellectual property rights and reinforced work on commercial matters, as well as access to the goods market.

(2) The proper functioning of the internal market entails the need to further improve and expedite the transmission and service of judicial and extrajudicial documents in civil or commercial matters for service between the Member States, to simplify the application of certain provisions of Regulation (EC) No 1348/2000 and to improve legal certainty for the applicant and the addressee.
(2) Le bon fonctionnement du marché intérieur exige d'améliorer et d'accélérer encore la transmission ainsi que la signification et la notification des actes judiciaires et extrajudiciaires en matière civile ou commerciale entre les États membres, de simplifier l'application de certaines dispositions du règlement (CE) n° 1348/2000 et de renforcer la sécurité juridique pour le requérant et pour le destinataire.

(8) Moreover, this Directive, and in particular its provisions relating to information about any contractual clause on law applicable to the contract and/or on the competent court does not affect the applicability to the distance marketing of consumer financial services of Council Regulation (EC) No 44/2001 of 22 December 2000 on jurisdiction and the recognition and enforcement of judgements in civil and commercial matters(5) or of the 1980 Rome Convention on the law applicable to contractual obligations.
(8) En outre, la présente directive, et notamment ses dispositions relatives aux informations concernant les clauses contractuelles sur la législation applicable au contrat et/ou la juridiction compétente, est sans préjudice de l'applicabilité à la commercialisation à distance des services financiers du règlement (CE) n° 44/2001 du Conseil du 22 décembre 2000 concernant la compétence judiciaire, la reconnaissance et l'exécution des décisions en matière civile et commerciale(5) et de la convention de Rome de 1980 sur la loi applicable aux obligations contractuelles.
