Member States shall draw up either a general market surveillance programme or sector specific programmes, covering the sectors in which they conduct market surveillance, communicate those programmes to the other Member States and the Commission and make them available to the public, by way of electronic communication and, where appropriate, by other means.
Les États membres établissent, soit un programme général de surveillance du marché, soit des programmes sectoriels spécifiques, couvrant les secteurs dans lesquels ils procèdent à la surveillance du marché. Directive 97/67/EC of the European Parliament and of the Council of 15 December 1997 on common rules for the development of the internal market of Community postal services and the improvement of quality of service (5) established a regulatory framework for the postal sector at Community level, including measures to guarantee a universal service and the setting of maximum limits for the postal services which Member States may reserve to their universal service provider(s) with a view to the maintenance of the universal service, to be reduced in a gradual and progressive manner, and a timetable for decision-making on the further opening of the market to competition, for the purposes of creating an internal market in postal services.
La directive 97/67/CE du Parlement européen et du Conseil du 15 décembre 1997 concernant des règles communes pour le développement du marché intérieur des services postaux de la Communauté et l’amélioration de la qualité du service (5) a instauré, à l’échelle communautaire, un cadre réglementaire pour le secteur postal comprenant des mesures visant à garantir la prestation d’un service universel, la fixation de limites maximales pour les services postaux susceptibles d’être réservés par les États membres à leurs prestataires du service universel en vue de préserver ledit service universel — limites qui devraient être progressivement abaissées —, de même qu’un calendrier pour la prise de décision concernant la poursuite du processus d’ouverture du marché à la concurrence, dans le but de créer un marché intérieur des services postaux.

For the purposes of these Guidelines, structural excess capacity in the agricultural sector will be defined by the Commission on a case-by-case basis taking account in particular of the extent and trend for the relevant product category over the past three years, of market stabilisation measures, especially export refunds and withdrawals from the market, of development of world market prices, and of the presence of sectoral limits in Community legislation.
Aux fins des présentes lignes directrices, la surcapacité structurelle dans le secteur agricole sera définie par la Commission au cas par cas en tenant compte notamment de l'ampleur et de la tendance, pour la catégorie de produit considérée, des mesures de stabilisation du marché au cours des trois dernières années, notamment des restitutions à l'exportation et des retraits du marché, de l'évolution des prix sur le marché mondial et des limitations sectorielles prévues par la réglementation communautaire.

The Commission should be able, after consulting the Communications Committee, to require a national regulatory authority to withdraw a draft measure where it concerns definition of relevant markets or the designation or not of undertakings with significant market power, and where such decisions would create a barrier to the single market or would be incompatible with Community law and in particular the policy objectives that national regulatory authorities should follow.
Il conviendrait que la Commission puisse, après consultation du comité des communications, demander à une autorité réglementaire nationale de retirer un projet de mesure ayant trait à la définition des marchés pertinents ou à la détermination des entreprises disposant d'une puissance significative sur le marché, et lorsque la mesure entraverait le marché unique ou serait incompatible avec le droit communautaire, et en particulier avec les objectifs politiques que les autorités réglementaires nationales devraient respecter.
