The Council of the European Union, in its Resolution of 11-12 December 2006 on a Strategy for a Secure Information Society in Europe, reiterated the importance of these tasks by calling upon “ENISA to continue working in close cooperation with the Member States, the Commission and other relevant stakeholders, in order to fulfil those tasks and objectives that are defined in the Regulation of the Agency and to assist the Commission and the Member States in their effort to meet the requirements of network and information security, thus contributing to the implementation and further development of the new Strategy for a Secure Information Society in Europe as set out in this Resolution”. [11]Since its establishment, ENISA has carried out activities and produced deliverables as defined in the Work programmes for 2005 and 2006.[12]

More recently, the Communication “A strategy for a Secure Information Society – Dialogue, partnership and empowerment”[2] reviewed the current state of threats to the Information Society and presented an updated policy strategy, highlighting the positive impact of technological diversity on security and the importance of openness and interoperability.

This Regulation establishes a European Union Agency for Network and Information Security (ENISA, hereinafter ‘the Agency’) to undertake the tasks assigned to it for the purpose of contributing to a high level of network and information security within the Union and in order to raise awareness of network and information security and to develop and promote a culture, of network and information security in society for the benefit of citizens, consumers, enterprises and public sector organisations in the Union, thus contributing to the establishment and proper functioning of the internal market.
1. Le présent règlement institue une Agence de l’Union européenne chargée de la sécurité des réseaux et de l’information (ENISA, ci-après dénommée «Agence») afin d’exécuter les tâches qui lui sont assignées en vue de contribuer à un niveau élevé de sécurité des réseaux et de l’information au sein de l’Union et en vue de sensibiliser la société à la sécurité des réseaux et de l’information et de favoriser l’émergence et promouvoir une culture de la sécurité des réseaux et de l’information, dans l’intérêt des citoyens, des consommateurs, des entreprises et des organismes du secteur public de l’Union, contribuant ainsi à l’établissement et au bon fonctionnement du marché intérieur.

The potential impact of these developments on the network and information security challenges for the EU has been highlighted by the Commission in its Communication on a strategy for a secure Information Society.[15] It is important to take these developments in due consideration when reflecting on the future of ENISA and deciding how the EU member States and stakeholders should cooperate to cope with new challenges for network and information security.
L'incidence potentielle de ces évolutions sur les défis posés à la sécurité des réseaux et de l'information pour l'UE a été soulignée par la Commission dans sa communication sur une stratégie pour une société de l'information sûre[15]. Il est primordial de prendre pleinement ces évolutions en considération lors du processus de réflexion sur l'avenir de l'ENISA et lors de la prise de décision sur la manière dont les États membres de l'UE et les parties concernées devraient coopérer pour affronter les nouveaux défis posés à la sécurité des réseaux et de l'information.

Since the objective of this Regulation, namely to establish a European Union Agency for Network and Information Security for the purpose of contributing to a high level of network and information security within the Union and in order to raise awareness and develop and promote a culture of network and information security in society for the benefit of citizens, consumers, enterprises and public sector organisations in the Union, thus contributing to the establishment and proper functioning of the internal market, cannot be sufficiently achieved by the Member States and can therefore be better achieved at Union level, the Union may adopt measures, in accordance with the principle of subsidiarity as set out in Article 5 of the Treaty on European Union.
Étant donné que l’objectif du présent règlement, à savoir instituer une Agence de l’Union européenne pour la sécurité des réseaux et de l’information en vue de contribuer à un niveau élevé de sécurité des réseaux et de l’information dans l’Union, et en vue de sensibiliser la société et de favoriser l’émergence et promouvoir, dans la société, une culture de la sécurité des réseaux et de l’information, dans l’intérêt des citoyens, des consommateurs, des entreprises et des organismes du secteur public de l’Union, contribuant ainsi à l’établissement et au bon fonctionnement du marché intérieur, ne peut pas être atteint de manière suffisante par les États membres et peut donc être mieux atteint au niveau de l’Union, celle-ci peut prendre des mesures conformément au principe de subsidiarité consacré à l’article 5 du traité sur l’Union européenne.

In response to the changing challenges, the Union has updated its priorities for network and information security policy in a number of documents, including the 2006 Commission Communication A strategy for a Secure Information Society — Dialogue, partnership and empowerment, the Council Resolution of 2007 on a Strategy for a Secure Information Society in Europe, the 2009 Communication Critical Information Infrastructure Protection – ‘Protecting Europe from large scale cyber-attacks and disruptions: enhancing preparedness, security and resilience’, the 2009 Presidency Conclusions of the Ministerial Conference on Critical Information Infrastructure Protection (CIIP) in Tallinn, the Council Resolution of 2009 on a collaborative European approach to Network and Information Security, the 2011 Presidency Statement following the Ministerial Conference on CIIP in Balatonfüred and the 2011 Council conclusions on Critical Information Infrastructure Protection "Achievements and next steps: towards global cyber-security".

To this end, a strategy for a secure information society was adopted in 2006, whose main elements were endorsed in Council resolution 2007/068/01.
