Without prejudice to Section I of this Chapter, where imports of products included in Annex I to the TFEU cause, or threaten to cause, serious disturbance to Union markets, in particular to one or more of the outermost regions, or these markets’ regulatory mechanisms, the Commission, on its own initiative or at the request of a Member State, after consulting the committee for the relevant agriculture or fisheries common market organisation, shall adopt an implementing act in order to suspend the preferential arrangements in respect of the products concerned in accordance with examination procedure referred to in Article 39(3).
Sans préjudice de la section I du présent chapitre, si les importations de produits figurant à l’annexe I du traité sur le fonctionnement de l’Union européenne perturbent ou menacent de perturber gravement les marchés de l’Union, notamment dans une ou plusieurs régions ultrapériphériques, ou les mécanismes régulateurs desdits marchés, la Commission adopte, de sa propre initiative ou à la demande d’un État membre, un acte d’exécution visant à suspendre les régimes préférentiels applicables aux produits concernés, en conformité avec la procédure d’examen visée à l’article 39, paragraphe 3, après consultation du comité chargé de l’organisation commune de marché concernée dans le secteur de l’agriculture ou de la pêche.

Where imports of products included in Annex I to the Treaty cause, or threaten to cause, serious disturbance to Community markets, in particular to one or more of the outermost regions, or these markets’ regulatory mechanisms, the Commission, on its own initiative or at the request of a Member State, may suspend the preferential arrangements in respect of the products concerned after consulting the management committee for the relevant common market organisation.

The European Supervisory Authority (European Banking Authority) established by Regulation (EU) No 1093/2010 of the European Parliament and of the Council (EBA), the European Supervisory Authority (European Insurance and Occupational Pensions Authority) established by Regulation (EU) No 1094/2010 of the European Parliament and of the Council (EIOPA) and the European Supervisory Authority (European Securities and Markets Authority) established by Regulation (EU) No 1095/2010 of the European Parliament and of the Council (ESMA) (hereinafter collectively referred to as “the ESA”) shall, through the Joint Committee of the ESA (Joint Committee), issue common guidelines aimed at the convergence of supervisory practices with regard to the application of paragraphs 2, 3, 3a, 4 and 5 of this Article.

In particular, the Commission should be able to adopt detailed rules of application in respect of the publication of information on beneficiaries of the common agricultural policy, in respect of intervention measures where no fixed sum per item has been laid down in a common market organisation and in respect of appropriations which have been carried over to finance the expenditure referred to in Article 3(1)(c) of that Regulation.

In line with the Conclusions drawn in November 2004 by the Presidency of the Council concerning the simplification of the Common Organisation of the Market for fruit and vegetables, the Commission has prepared an analysis of the Community market for soft fruit intended for processing. This analysis is now in its final stage and will feed the debate on the reform of the Common Market Organisation for fruit and vegetables.

Might we not allow extended transitional arrangements so that they can adapt to competition in the common market but be allowed to protect local markets until such time as they are more competitive?
