2. Where, through the application of paragraph 1, a self-employed person would not be required to contribute under the legislation of either of the Contracting Parties in respect of his or her self-employed activities, the competent authorities of the Contracting Parties or their delegated institutions or agencies shall, by common agreement, determine to which legislation that person will be subject.

It is also interesting to note, that the Court, also in the Danosa judgment, states that, for the purposes of protection against discrimination on grounds of sex, even where a board member would not fulfil the conditions defining a worker under EU law – and thus not fall within the scope of Directive 92/85/EEC or of Directive 76/207/EEC, this person would fall "to the extent that the referring court categorises her as ‘a self-employed person’ – within the scope of Directive 86/613, which applies to self-employed persons and which, as is stated in Article 1 of that directive, supplements Directive 76/207 as regards the application of the principle of equal treatment for those workers".

1. By way of derogation from Article 65, a wholly unemployed person who as a frontier worker most recently completed periods of insurance as a self-employed person or periods of self-employment recognised for the purposes of granting unemployment benefits and whose Member State of residence has submitted notification that no possibility exists for any category of self-employed persons to be covered by the unemployment benefits system in that Member State, shall register with and make himself/herself available to the employment services in the Member State in which he/she pursued his/her last activity as a self-employed person and continuously adhere to the conditions laid down under the legislation of the latter Member State when he/she applies for benefits.

This proposal would exempt self-employed drivers from the scope of the current directive and, for the first time in European legislation, we would have an attempt to distinguish between ‘real’ self-employed persons and ‘false’ self-employed persons.

Where, under the legislation of the Member State which is competent under Title II of Regulation (EC) No 883/2004, no child-raising period is taken into account, the institution of the Member State whose legislation according to Title II of that Regulation was applicable to the person concerned because that person pursues an activity as an employed or self-employed person at the date when, under this legislation, the child-raising period started to be taken into account for the child concerned, shall continue to be responsible for recognising this child-raising period as a child-raising period under its own legislation, as if this child raising took place in its territory. The obligation under paragraph 2 shall not apply if the person concerned is or becomes subject to the legislation of any Member State due to the pursuit of an employed or self-employed activity.

This annual revision is also important in view of the substance of the issues dealt with: definitions of the terms ‘employed person’ and ‘self-employed person’ when these cannot be established on the basis of national legislation (Annex I, Section1), definition of ‘member of the family’ when national legislation does not permit a distinction to be drawn between family members and other persons (Annex I, Part 2), special schemes for self-employed persons excluded from the scope of the Regulation (Annex II, Section 1), special childbirth or adoption allowances excluded from the scope of the Regulation (Annex II, Section 2), special non-contributory benefits supplied solely to persons on the territory of the Member State of residence, thus constituting an exception to the rule of exportable benefits (Annex II a), existing bilateral conventions which were in force before the implementation of the Regulation in the Member States concerned (Annex III), legislation under which the amount of invalidity benefit is independent of the length of insurance periods (Annex IV, Section A), cases where the calculation of benefit may be waived because it will not yield a higher amount (Annex IV, Section C), special procedures for implementation in certain Member States (Annex VI), and schemes that provide only for family allowances or supplementary or special allowances for orphans (Annex VIII).
