E. whereas the Deputy Minister of Justice of the Republic of Azerbaijan, Vilayat Zahirov, sent an official letter to the Ministry of Public Administration and Justice of Hungary on 15 August 2012, in which he stated that the execution of the decisions of foreign states’ courts regarding the transfer of sentenced persons to serve the remaining part of their prison sentences in the Republic of Azerbaijan were carried out in accordance with Article 9(1)(a) of the convention, without any conversion of their sentences; whereas he further gave an assurance that, according to the Criminal Code of the Republic of Azerbaijan, the punishment of a convict serving a life sentence could only be replaced by a court with a term of imprisonment for a specified period, and that the convict could be released on conditional parole only after serving at least 25 years of his or her prison sentence; and whereas the Azerbaijani authorities subsequently denied having given any diplomatic assurances to the Hungarian authorities;

As for the various modes of enforcement of custodial penalties, and before going on to consider whether there are grounds for Union action here, see the more detailed presentation in Annex I. That annex deals with suspended sentences, suspended or deferred sentencing, day-release, sentences served in instalments, electronic surveillance and home detention.

If the offence on the basis of which the European arrest warrant has been issued is punishable by life sentence or life-time detention order, the execution of the European arrest warrant may be subject to the condition that the issuing Member State undertakes to encourage the application of any measures of clemency to which the person is entitled under its national law and practice and that whatever the sentence imposed by the issuing Member State in accordance with its national law, the actual sentence served will not exceed the maximum applicable in the executing Member State .

The transfer of enforcement of a sentence involving deprivation of liberty may be requested where (a) the sentenced person is in the territory of the administering State and is a national of that State or is permanently resident in its territory; or (b) the sentenced person is in the territory of the administering State and his extradition has been refused, would be refused if requested, or is not possible; or (c) the sentenced person is in the territory of the administering State and is serving or is to serve a custodial sentence there (Article 3).

A solution to this problem in the European Union might consist of setting a minimum period during which the sentenced person would continue to serve his sentence in the convicting Member State so as to avoid situations in which he might be released immediately on transfer to the State of enforcement or serve a much lighter sentence than in the sentencing State.
Pour résoudre ce problème, on pourrait penser à introduire, au niveau de l'Union européenne, un délai minimum au cours duquel un condamné continuerait à purger sa peine dans l'État de condamnation afin d'éviter qu'il soit immédiatement libéré suite au transfert dans l'État d'exécution ou qu'il purge une peine beaucoup moins sévère que celle imposée par l'État de condamnation.
