Recalls that Regulation (EC) No 2201/2003 lays down the principle that children should be able to maintain their relationships with both parents after the latter have separated, even if they live in different Member States; points out that, although the introduction and application of substantive rules on access rights is currently a Member State matter, the Member States must respect Union law when exercising their powers, in particular the Treaty provisions concerning the freedom of all EU citizens to travel and reside in another Member State as well as maintaining ties between parents and children, grandparents and grandchildren, and brothers and sisters; adds that the occasionally lengthy waiting periods and the number of procedures constraining parents who wish to return to their home country with their child/children are a barrier to the free movement of EU citizens; calls on the Commission to investigate alleged discrimination against the non-German spouse in mixed marriages by the German Youth Welfare Office (Jugendamt );

That memorandum of understanding, which is separate from the treaty but is offered by Chief Hope to Stó:lō, sets out detailed dispute resolution provisions that are comparable to what is in the treaty itself.

In view of the protocol's rules on jurisdiction and the recognition and enforcement of judgments, the Council decided for legal reasons to take two separate decisions on the accession: one covering the transport part of the protocol and legally based on the Lisbon treaty's transport policy provisions; and another on the civil law part, with the treaty provisions on judicial cooperation in civil matters as a legal basis.

Notes that, with respect to the external action of the Union, the Treaty of Lisbon makes major structural alterations in comparison with the Treaty establishing a Constitution for Europe (2004) by separating Title V of the Treaty on European Union – containing general provisions on the Union’s external action, specific provisions on common foreign and security policy (CFSP) and provisions concerning common security and defence policy (ESDP) – from Part Five of the Treaty on the Functioning of the European Union – containing general provisions on the Union’s external action, common commercial policy, cooperation with third countries and humanitarian aid, restrictive measures, international agreements, relations with international organisations and third countries and EU delegations, and the solidarity clause;

The agreement also contains the following remarkable provision which is self-explanatory: “Prior to consenting to be bound by an international treaty that may affect a right of the Tlicho government, the Tlicho First Nation or a Tlicho citizen, flowing from the agreement, the Government of Canada shall provide an opportunity to the Tlicho government to make its views known with respect to the international treaty either separately or through a forum”.

34. Calls on the Commission to investigate whether and to what extent the incorporation in the Treaty of a separate specific provision or protocol concerning the film and audiovisual industry and the cultural sector in general could take account of the specific nature of the industry;
