Welcomes the fact that Serbia has an adequate legal and institutional framework for protecting human rights and fundamental freedoms; notes, however, the remaining shortcomings in its implementation, particularly with regard to preventing discrimination against vulnerable groups, including people with disabilities, people with HIV/AIDS and LGBTI people; welcomes the successful Pride March of 20 September 2015; underlines, however, that discrimination and violence against LGBTI persons is still a matter of concern; encourages in this connection the government to address Recommendation CM/Rec(2010)5 of the Committee of Ministers of the Council of Europe to member states; expresses concern at the number of attacks on members of vulnerable groups that have not yet been fully investigated; moreover expresses concern at the continuous problem of domestic violence; calls on the authorities to actively promote respect for human rights for all;

G. whereas in July and September 2015 the Hungarian Parliament adopted a number of amendments, relating in particular to the law on asylum, the penal code, the law on criminal procedure, the law on the border, the law on the police and the law on national defence; whereas the Commission’s preliminary assessment revealed a number of serious concerns and questions regarding compatibility with the asylum and borders acquis and the Charter of Fundamental Rights; whereas on 6 October 2015 the Commission sent an administrative letter to the Hungarian Government; whereas the Hungarian Government responded to that letter; whereas on 10 December 2015 the Commission opened an infringement procedure against Hungary;
G. considérant qu'en juillet et en septembre 2015, le Parlement hongrois a adopté plusieurs amendements portant notamment sur la loi régissant les conditions d'asile, sur le code pénal, sur le code de procédure pénal, sur la loi de protection des frontières, sur le code de police et sur la loi sur la défense nationale; considérant que l'évaluation préliminaire de la Commission a suscité un certain nombre de préoccupations et de questions graves portant sur la compatibilité avec l'acquis en matière d'asile et la charte des droits fondamentaux; que, le 6 octobre 2015, la Commission a adressé une lettre administrative au gouvernement hongrois; que le gouvernement hongrois a répondu à ce courrier; que, le 10 décembre 2015, la Commission a ouvert une procédure d'infraction à l'encontre de la Hongrie;

Set aside the judgment of the judgment of the General Court (Eighth Chamber) delivered on 24 September 2015 in Case T-674/11 TV2/Danmark A/S v European Commission, in so far as it annuls Commission Decision 2011/839/EU of 20 April 2011 concerning Danish measures (C 2/03) in favour of TV2/Danmark (1) in so far as that decision finds that advertising revenue from 1995 and 1996 constitutes State aid.

Observes with concern that the issue of conflicts of interests is extremely relevant with regards to the members of the panel of experts who are called to test and authorise the products; expresses its deep concern about the two revolving door cases identified by the Agency in 2013 and recommends that the Agency further strengthen its independence policy, especially in publishing the CVs and declarations of interests of managers, members of the Advisory Board and the panel of experts by the end of September 2015; calls upon the Agency to adopt comprehensive policies for the management of situations where conflicts of interests arrive, such as the divestment of a public official's interests, the recusal of the public official from involvement in an affected decision-making process, the restriction of access by the affected public official to particular information and the rearrangement of the public official's duties or the resignation of the public official from their office;
