4. Welcomes the progress made in 2015 in reaching agreements in the framework of the process of normalisation of relations between Kosovo and Serbia, namely on the establishment of the Association/Community of Serb-majority municipalities in Kosovo, on energy and on Mitrovicë/Mitrovica bridge, and including the agreements of 25 August 2015 on telecoms, of June 2015 on vehicle insurance and of February 2015 on the judiciary; supports the continued mediation efforts of the Vice-President of the Commission / High Representative of the Union for Foreign Affairs and Security Policy (VP/HR) with a view to the normalisation of relations between Serbia and Kosovo, which has yet to be fully achieved; calls on the European External Action Service to make a thorough overall assessment of the state of implementation of all the agreements signed so far with regard to the adoption of laws on the ground, and to report regularly on this to the European Parliament and the parliaments of both Kosovo and Serbia; urges the VP/HR to identify shortfalls and to demand that the parties fulfil their commitments, and calls on Serbia and Kosovo to refrain from negative rhetoric, to move forward in good faith and in a timely manner with the full implementation of all the agreements already reached, and to continue determinedly the normalisation process; stresses that continuous and constructive dialogue between Pristina and Belgrade and the full implementation of the agreements reached are crucial for the normalisation of their relations;

However, Serbia and Montenegro should be urged to improve cooperation between the State Union and the two Republics in order to effectively implement the European Partnership through the relevant Action plan.

Underlines the importance of constructive social dialogue for economic development in Serbia; urges the government to promote capacity building for genuinely independent unions and employers’ organisations and to create a framework and political space for social dialogue and collective agreements;

Welcomes Serbia’s continued engagement in the normalisation process with Kosovo, and the finalisation of key agreements on 25 August 2015, namely on the establishment of the Association/Community of Serb majority municipalities in Kosovo, on energy, on telecoms and on the Mitrovica Bridge; urges Serbia to swiftly implement its part of these agreements and to engage constructively with Kosovo in formulating and implementing future agreements; notes that progress has been made in areas such as police and civil protection, vehicle insurance, customs, liaison arrangements and cadastral records; reiterates that progress in the Dialogue should be measured by its implementation on the ground; calls on Serbia and Kosovo to refrain from negative rhetoric and to move forward with the full implementation, in good faith and in a timely manner, of all the agreements already reached, and to determinedly continue the normalisation process; calls for continuous efforts by both governments and the EU institutions to communicate and explain the provisions of the reached agreements, in order to bring ethnic Albanian and Serbian communities in Kosovo closer together; commends the efforts of the business community, led by Chambers of Commerce, to contribute to the normalisation of relations, by engaging in dialogue between Chambers of Commerce of Serbia and Kosovo, to tackle barriers to doing business between the two sides, and to facilitate contact and cooperation between companies; calls on the Commission to support maintaining and developing these activities in the future; encourages Serbia and Kosovo to identify new areas of discussion for the dialogue with the aim of improving people’s lives and comprehensively normalising relations; calls on the European External Action Service (EEAS) to conduct an evaluation of the performance of the two sides in fulfilling their obligations; urges Serbia to act in a spirit of good-neighbourly relations and expresses the hope that t ...

Urges all Member States to collaborate fully in international criminal justice mechanisms, and especially in bringing fugitives to justice; in this regard, notes with satisfaction the cooperation of the Democratic Republic of the Congo in the transfer of Germain Katanga to the ICC, the cooperation of Serbia in the arrest and transfer of Zdravko Tolimir to the International Criminal Tribunal for the former Yugoslavia (ICTY) and the cooperation of Serbia and Montenegro in the arrest and transfer of Vlastimir Đjorđjević to the ICTY; however, notes with concern the persistent failure of Sudan to cooperate with the ICC by arresting and transferring Ahmad Muhammad Harun and Ali Muhammad Ali Abd-Al-Rahman; notes with concern that the ICC warrants for the arrest of four members of the Lord's Resistance Army in Uganda have not yet been executed; also notes with concern that Radovan Karadžić and Ratko Mladić remain at large and have not been brought before the ICTY; in this regard, calls on the Serbian authorities to ensure full cooperation with the ICTY, which should lead to the arrest and transfer of all remaining indictees, in order to open the way to the ratification of a Stabilisation and Association Agreement; considers further that the current proceedings brought against Liberia's former President, Charles Taylor, by the Special Court for Sierra Leone in The Hague constitute a significant development towards the ending of impunity;

Vigorously condemns the assassination of the Serbian Prime Minister Zoran Djindjic and expresses its condolences to his family and the people of Serbia; urges the governments of Serbia and Montenegro to keep up the pace of reform and to take all necessary steps to strengthen democratic institutions and fight organised crime and corruption; calls on the Council and Commission to assist Serbia and Montenegro closely so as to help it move closer to the EU and play a primary role in the Stabilisation and Association Process;
29. condamne énergiquement l'assassinat du Premier ministre serbe Zoran Djindjic et exprime ses condoléances à sa famille ainsi qu'au peuple de Serbie; engage instamment les gouvernements de la Serbie et du Monténégro à maintenir le rythme des réformes et à prendre toutes les dispositions nécessaires pour renforcer les institutions démocratiques et combattre la criminalité organisée et la corruption; invite le Conseil et la Commission à assister la Serbie et le Monténégro autant qu'il le faut pour les aider à se rapprocher de l'Union européenne et à jouer un rôle de premier plan dans le processus de stabilisation et d'association;

12. Regrets the fact that no action has been undertaken as to the 2000 Albanian war prisoners still held in Serbia; urges the Council to make every effort so as to obtain fair treatment of them by the Yugoslav authorities and their rapid release;
12. déplore qu’aucune mesure n’ait été prise à l’égard des 2000 prisonniers de guerre albanais encore maintenus en détention en Serbie; prie instamment le Conseil de faire tout son possible pour obtenir que les autorités yougoslaves leur réservent un traitement équitable et les libèrent rapidement;

In the light of recent events the EU understands the willingness of Montenegro to undertake serious efforts to restructure the relationship between Serbia and Montenegro, and urges the authorities of Serbia and Montenegro to commence a genuine dialogue on the future constitutional arrangements of the FRY in a peaceful manner.
A la lumière des récents événements, l'UE comprend que le Monténégro est prêt à déployer de sérieux efforts pour restructurer les relations entre la Serbie et le Monténégro, et demande instamment aux autorités de la Serbie et du Monténégro d'entamer d'une manière pacifique un dialogue véritable sur les futures dispositions constitutionnelles de la RFY.
