First of all, the French authorities pointed out that the contract for services between the state and EDF had provided for a remuneration of the state resulting from two elements: (i) a fixed rate of 3 % on its capital contributions; and (ii) additional remuneration of 40 % of EDF's net income, which demonstrated that the state had information on the expected yield on the invested capital.

Allow me to make a few short remarks. On services of general interest in particular, I will say clearly that we should take specific national circumstances into account, because it is true that some of our fellow citizens are a little alarmed – I am thinking, for example, of the French – when they feel, wrongly, that Europe is endangering the public services which are a French tradition. Likewise, in relation to public contracts, we should take account of individual circumstances, and especially of those which allow for collaboration between several public authorities.
Quelques brèves remarques: s’agissant en particulier des services d’intérêt général, il convient - je le dirai clairement - de prendre en compte les spécificités nationales car il est vrai que certains de nos concitoyens sont un peu effrayés - je pense par exemple aux Français - lorsqu’ils ont - à tort - le sentiment que l’Europe met en cause les services publics qui sont dans la tradition française. Il convient, de même, en matière de marchés publics, d’avoir égard aux situations particulières, et notamment celles qui permettent la collaboration entre plusieurs collectivités publiques.

Under French law, it is possible for municipalities and public establishments for cooperation between local authorities to pool their services in order to achieve economies of scale (Article L. 5211-4-1 II of the General Code governing Local and Regional Authorities).

The option of not changing the final decision would, on the one hand, enable France to grant individual aid to services between French ports under conditions more favourable than those provided in the new Community guidelines and, on the other hand, penalise France in setting up projects for services between a French port and a port of another Member State through formal procedures as envisaged in recital 26 of the final decision.

The 26th recital of the final decision states that France accepts procedural conditions which are in particular binding on projects granting aid to an intra-Community sea shipping service between a French port and a port of another Member State and not on those involving sea shipping services between two French ports.
La décision finale fait état, à son considérant 26, de l’acceptation par la France de conditions de nature procédurale, qui sont particulièrement contraignantes pour les projets d’aide en faveur d’une ligne maritime intracommunautaire entre un port français et un port d’un autre État membre et non pour ceux concernant des liaisons maritimes entre deux ports français.

The proposed amendment will enable France to bring its scheme into line with the provisions laid down in the new Community guidelines in respect of sea shipping services between a French port and a port of another Member State and will also enable projects granting aid to sea shipping services between two French ports to be made subject to the conditions laid down in the new Community guidelines.
