10 (1) Subject to subrule (3), on receiving a notice that is endorsed in accordance with subrule 9(1), the appropriate Provincial Court Judge, justice or justices of the peace, officer or clerk, as the case may be, shall immediately return the record, which consists of the conviction, acquittal, order or warrant, together with all things relating to the matter, including the information, any evidence and exhibits filed and the notice served on him or her, to the office mentioned in the notice, with a certificate endorsed on the notice in the manner set out in Form B of the schedule.

127. A solicitor who assumes the representation of an accused who was previously either unrepresented or represented by another solicitor shall immediately file a notice to that effect with the Court and serve a copy of the notice on the prosecutor.

(2) If each of the persons to whom a notice is sent under subsection (1) serves a notice on the Minister under that subsection that they elect to accept the abandonment, the Minister may cause a notice of abandonment of the expropriated interest or right or the remainder of the interest or rights, as the case may be, to be sent to each of those persons and to the Attorney General of Canada, who shall immediately confirm the abandonment by causing the notice to be registered in the office of the registrar where the notice of confirmation was registered.
