In its judgment delivered in November 2009 , the General Court upheld OHIM’s decision by finding that the sign ‘1000’ alludes to a quantity and, with regard to the goods referred to in the application for registration, will immediately be perceived by the relevant public, without further thought, as a description of the characteristics of the goods in question, in particular the number of pages and works, amount of data, or the number of puzzles in a collection, or the ranking of items referred to in them.
Dans son arrêt rendu en novembre 2009 , le Tribunal a confirmé la décision de l'OHMI en estimant que le signe « 1000 » renvoie à une quantité et, à l’égard des produits visés dans la demande d’enregistrement, sera perçu immédiatement et sans autre réflexion par le public concerné comme une description de caractéristiques des produits en cause, notamment la quantité de pages ainsi que d’œuvres, d’informations et de jeux compilés, ou le classement hiérarchique de références contenues.
