21. Deplores the fact that the 2002 Interinstitutional Agreement did not set out more clear-cut arrangements on access to classified information concerning the common foreign and security policy than the adoption of ad hoc decisions; stresses, therefore, that it is of the utmost importance that Parliament and the Council begin negotiations with a view to amending the 2002 Interinstitutional Agreement to reflect both the reforms carried out since it was concluded and the current situation;
4. regrette que l'accord interinstitutionnel de 2002 n'ait pas fixé des modalités plus précises que l'adoption de décisions ad hoc, en ce qui concerne l'accès aux informations classifiées relatives à la politique étrangère et de sécurité commune; souligne, par conséquent, qu'il est de la plus haute importance que le Parlement européen et le Conseil engagent des négociations visant à modifier l'accord interinstitutionnel de 2002 dans le but de refléter tant les réformes menées depuis sa conclusion que la situation actuelle;

That is why I propose that, given the seriousness of the situation, an interinstitutional conference be organised without delay. The latter would involve all those who play a part in the management and monitoring of Community funds, and would be used to start off a comprehensive discussion enabling us to envisage the reforms needed to obtain a positive statement of assurance as soon as possible.

Moreover, to ensure the neutral selection of OLAF's management staff, guarantees exist in the form of the special composition of the Commission's Consultative Committee on Appointments, chaired by its Secretary-General with the participation of the Director-General for Personnel and Administration, but which also, to take account of OLAF's specific situation and interinstitutional mission, comprises representatives of the Court of Justice, Court of Auditors and Supervisory Committee and meets in the presence of an external consultant.

[20] Information goes direct to the Office under Article 2 if any "official or servant of [the institution or body] becomes aware of evidence which gives rise to a presumption of the existence of possible cases of fraud, corruption or any other illegal activity detrimental to the interests of the Communities, or of serious situations relating to the discharge of professional duties ..". To allow more flexible management in any similar situation stemming from Article 41(3) EU, the Commission intends in due course to propose an interinstitutional agreement along the lines of the agreement already concluded under the common foreign and security policy, respecting the powers of each institution.
Cette situation pouvant se reproduire à l'avenir, la Commission envisage, pour permettre une gestion plus souple de situations similaires découlant de l'article 41 3 du TUE, la possibilité de proposer le moment venu un accord interinstitutionnel respectant les compétences de chacune des institutions et s'inspirant de l'accord déjà conclu dans le cadre de la politique étrangère et de sécurité commune.
