On 13 September and 14 December 2016, the Commission took part in Plenary debates of the European Parliament on the situation in Poland and explained what has happened since the adoption of its Recommendation of July 2016, and how the Commission sees the situation.

After the adoption of an Opinion on the situation in Poland on 1 June, the Polish Parliament adopted a new Law on the Constitutional Tribunal on 22 July.The Commission has assessed the overall situation, including in the light of the new law, and reaches the conclusion that even if certain of its concerns have been addressed by that law, important issues of concern regarding the rule of law in Poland remain.
Après l'adoption, le 1 juin, d’un avis sur la situation en Pologne, le Parlement polonais a adopté, le 22 juillet, une nouvelle loi sur le Tribunal constitutionnel.Ayant examiné la situation dans sa globalité, notamment à la lumière de la nouvelle loi, la Commission a abouti à la conclusion que, même si ce texte prend en compte certaines de ses préoccupations, d’importants sujets d'inquiétude subsistent en ce qui concerne l’état de droit en Pologne.

On 18 May, the College of Commissioners discussed the situation concerning the rule of law in Poland based on an oral presentation by First Vice-President Timmermans regarding the state of play of the intensive dialogue that has been ongoing with the Polish authorities since 13 January on the situation of the Constitutional Tribunal, and examined a draft Rule of Law Opinion.
Le 18 mai, le collège des commissaires a débattu de la situation actuelle de l’état de droit en Pologne, sur la base d’une présentation orale du premier vice-président Timmermans consacrée à l’état d’avancement du dialogue approfondi sur la situation du Tribunal constitutionnel, qui se poursuit avec les autorités polonaises depuis le 13 janvier, et il a examiné un projet d’avis sur l’état de droit.

The College of Commissioners today discussed the current situation concerning the Rule of Law in Poland – based on an oral presentation by First Vice-President Timmermans regarding the state of play of the intensive dialogue that has been ongoing with the Polish authorities since 13 January on the situation of the Constitutional Tribunal.
Le collège des commissaires a débattu, ce jour, de la situation actuelle de l’état de droit en Pologne, sur la base d’une présentation orale du premier vice-président Timmermans consacrée à l’état d’avancement du dialogue approfondi sur la situation du Tribunal constitutionnel, qui se poursuit avec les autorités polonaises depuis le 13 janvier.

I understand that other European regions possibly have the same problem as well and the situation is not any better (is it?), but today I am talking about my region and therefore in this case, we would like to have the opportunity to reach Western and Central Europe through Poland, once Poland has joined our rail track. Otherwise, we will be isolated from the EU’s transport system.
Je suis conscient que d’autres régions d’Europe sont sans doute confrontées au même problème et que leur situation n’est pas meilleure (l’est-elle?), mais, aujourd’hui, il est question de ma région et, à cet égard, nous souhaiterions avoir la possibilité d’atteindre l’Europe occidentale et centrale à travers la Pologne, une fois que la Pologne se sera connectée à notre réseau ferroviaire. Sinon, nous resterons isolés du système de transport de l’UE.

1. Encourages the Commission to look at the discrepancies between the legal situation of Members of the European Parliament elected in Poland and that of Members of the Polish Sejm and Senat , and to engage as a matter of urgency in contacts with the competent authorities in Poland with a view to identifying how to eliminate the manifest discrimination between the Members of the two Parliaments as regards their eligibility;
1. encourage la Commission à examiner les divergences entre la situation juridique des députés au Parlement européen élus en Pologne et celle des députés du Sejm et du Senat polonais, et à nouer de toute urgence des contacts avec les autorités compétentes en Pologne afin de déterminer la méthode à suivre pour mettre un terme à la discrimination manifeste dont sont victimes les députés des deux assemblées parlementaires en matière d'éligibilité;

I would like to say that it is extremely important to be able to trust that, having been introduced, the rules of the game will be applied, and then to assess the situation. Poland’s example shows that the introduction of the principles set out in the Copenhagen criteria can be a good omen, but that these principles also have to be implemented once the countries have joined the European Union.
Nous devons être en mesure de nous assurer que les règles du jeu sont mises en œuvre après leur adoption, puis d’évaluer la situation. L’exemple de la Pologne révèle que, si l’introduction des principes définis par les critères de Copenhague peut être un bon présage, il est important que ces principes soient également appliqués après l’adhésion du pays à l’Union européenne.

The resulting situation caused an undesirable turnaround of affairs for Poland, which was compelled to ask the European Commission Representative to agree to reopening the tender and extending the contract period, or to agree to initiating an open tender with a shortened notice period. If agreed to, this will unquestionably lead to all manner of procedural activities with huge time pressures and funds will have to be committed from Poland's own budget which had been allocated to other objectives linked to the fight against contagious diseases.
De ce fait, les choses ont pris une tournure non désirée par la partie polonaise, qui s’est retrouvée dans l’obligation de demander à la Représentation de la Commission de bien vouloir autoriser soit la réouverture de l’appel d’offres et la prolongation des délais d’adjudication, soit le lancement d’un nouvel appel d’offres assorti d’un avis de marché d’une durée plus courte qui, en cas d’autorisation, déclenchera nécessairement toutes sortes de procédures en un temps très limité parallèlement à l’obligation d’engager des fonds propres destinés au départ à d’autres actions de lutte contre les maladies contagieuses.

4. Understands that the opinion of the Scientific Committee to place Poland, as other candidate countries, in group 3 concerning the risk of BSE aims excusively at protection of the interests of the consumers in Poland and in the European Union; urges Poland to invest rapidly in the restructuring of slaughterhouses and to withdraw all material at risk in accordance with the European directives on the subject; urges also that the integrated system for administration and control be reviewed so as to enable livestock to be systematically traced, and welcomes the actions already undertaken by the Polish authorities to improve the situation;
4. comprend que l'avis du comité scientifique de placer la Pologne, ainsi que d' autres pays candidats, dans le groupe 3 en ce qui concerne le risque de l'ESB ne vise qu'à protéger l'intérêt des consommateurs à la fois en Pologne et au sein de l'Union européenne et encourage la Pologne à investir rapidement dans la restructuration des abattoirs, en en retirant tout le matériel à risque, conformément aux directives européennes en la matière; encourage en outre la redéfinition du système intégré d'administration et de contrôle qui devrait permettre d'assurer la traçabilité systématique des têtes de bétail et salue les actions déjà mises en place par les autorités polonaises pour améliorer la situation;
