In 2007, the Spanish authorities introduced a scheme ('environmental incentive') to support the installation of new sulphur oxide filters in existing coal power plants.
En 2007, les autorités espagnoles ont mis en place un régime («Incitations environnementales») visant à promouvoir l'installation de nouveaux filtres à oxyde de soufre dans les centrales à charbon existantes.

We currently believe that this Spanish scheme did not incentivise coal power plants to reduce harmful sulphur oxide emissions – they were already under an obligation to do so under EU environmental law.

(37) The aid of EUR 268196000 which Spain proposes to grant is intended to cover, with the exception of the costs for the payment of social welfare benefits borne by the State as a special contribution pursuant to Article 56 of the Treaty, compensation paid to workers in Spanish coal undertakings who have lost their jobs or have had or will have to take early retirement under the modernisation, rationalisation, restructuring and activity-reduction plan for the Spanish coal industry.

(12) The Commission has analysed the measures taken to modernise, rationalise, restructure and reduce activity in other Spanish coal undertakings during 2001 and the measures notified for the period 1 January 2002 to 23 July 2002 and has found that, except for the analysis which has to be made of the measure referred to in recital 11, they correspond to the plans which it declared, by Decision 98/637/ECSC, to be in conformity with Decision No 3632/93/ECSC.
(12) La Commission a analysé les mesures de modernisation, de rationalisation, de restructuration et de réduction d'activité des autres entreprises de l'industrie houillère de l'Espagne pendant l'année 2001 et celles notifiées pour la période du 1er janvier 2002 au 23 juillet 2002. (39) The remaining EUR 77530000 is intended to cover compensation for some 7000 workers from other undertakings in early retirement by 23 July 2002 as a result of the modernisation, rationalisation, restructuring and activity-reduction measures for the Spanish coal industry.

The Commission, moreover, takes due note of the fact that the coal mines are located in regions which are extremely dependent on the employment they generate, as is shown by the considerable amounts of aid authorised each year to the Spanish coal industry.

This request for information concerns the objectives included in the Spanish coal plan, drawn up jointly between the government and the trade unions, specifying that “businesses which cannot maintain their activity unaffected in the context of a reduction of the aid must follow Article 4 of the decision in order to initiate adequate processes of restructuring and rationalisation”. or that “overall aid for the operation of underground mines shall be reduced by 4% annually and aid to open-cast mines by 6% annually per business”.

The measure covers some 3 million tce (tonnes of coal equivalent) of Spanish coal a year.

The measures included compensatory payments to electricity producers using Spanish coal produced by undertakings that have negotiated contracts with the said electricity producers under the NSCCT (new system of public contracts for coal used in power stations), a system to be financed by a compensation fund managed by Ofico (Electricity Compensation Office).
Au nombre de celles-ci figuraient les montants compensatoires accordés aux producteurs d'électricité consommant du charbon espagnol produit par des entreprises ayant conclu un contrat avec lesdits producteurs dans le cadre du « nouveau système de passation des marchés pour le charbon utilisé dans les centrales thermiques (NSCCT) ».
