If a referendum were to be organised in line with the Spanish Constitution it would mean that the territory leaving would find itself outside of the European Union.
Si un référendum était organisé d'une façon qui serait conforme à la Constitution espagnole, cela signifierait que le territoire qui partirait se retrouverait en dehors de l'Union européenne.

Article 1 of the Statute of Autonomy of the Basque Country (Organic Law 3/1979) states: 'The Basque people, or Euskal Herria, as an expression of its nationality and in order to attain self-government, constitutes itself as an autonomous community within the Spanish state under the name of Euskadi or the Basque Country, in accordance with the Constitution and with the present Statute, which is its fundamental law'.
El artículo 1 del Estatuto de Autonomía del País Vasco (Ley Orgánica 3/1979) reza exactamente de esta manera «El Pueblo Vasco o Euskal Herria, como expresión de su nacionalidad, y para acceder a su autogobierno, se constituye en Comunidad Autónoma dentro del Estado español bajo la denominación de Euskadi o País Vasco, de acuerdo con la Constitución y con el presente Estatuto, que es su norma institucional básica».

– (ES) Mr President, I would like to supplement Mr Ortuondo’s question, and remind him that this is not a decision by the Spanish Government, but that it is the Spanish Constitution itself which prevents an autonomous community from holding a referendum unilaterally and requires that any referendum be called by the King, on the proposal of the President of the Government, following authorisation from the Congress of Deputies.

It is a sad fact that successive Spanish Governments have failed to champion the official languages recognised by the relevant Statutes of Autonomy, earmarking for development the principles and rights of the Spanish Constitution itself.
Il est regrettable que les gouvernements espagnols successifs aient été incapables de plaider la cause des langues officielles reconnues par les lois d’autonomie concernées, permettant de ce fait le développement des principes et des droits inscrits dans la Constitution espagnole.

Consequently, on condition that the Spanish Government notifies the Commission in advance of any proposal to formalise the guarantee, the Commission concludes that Law 7/93 of itself does not confer any special advantage on SNIACE and does not therefore constitute a State aid.
