16.Highlights the very constructive work undertaken by the entire Committee as regards the petitions received which concern the Spanish law on coastal management (Ley de Costas) both as regards the results and conclusions of the fact-finding visit and as regards the cooperation with both petitioners and the responsible national authorities; recalls that a special ad hoc working group was established by the Committee to look at this complex issue in more detail and to ensure liaison with the very large number petitioners concerned; recognises that although some advances were obtained for petitioners in the new legislation adopted by the Spanish Parliament there are some unresolved concerns, both in the field of property rights and environmental protection some of which have now been addressed to the Spanish Constitutional Court; requests the Commission to continue to actively monitor the issue;

That being so, in order to determine whether, in the circumstances, the non-recognition of periods of service completed by Mr Rosado Santana as an interim civil servant constitutes discrimination, it is for the Spanish Court to establish, first, whether Mr Rosado Santana, when he was working as an interim civil servant, was in a situation comparable with that of the career civil servants admitted to the promotion procedure.
Ce faisant, afin de déterminer si, en l’espèce, la non-reconnaissance des périodes de service accomplies par M. Rosado Santana en tant que fonctionnaire intérimaire constitue une discrimination, il appartient à la juridiction espagnole d’établir, dans un premier temps, si M. Rosado Santana – lorsqu’il exerçait ses fonctions en tant que fonctionnaire intérimaire – se trouvait dans une situation comparable à celle des fonctionnaires statutaires admis à participer à la procédure de promotion.

The Court thus recalls that the Commission’s inaction between 1996 and 2000 could not constitute implied approval of the aid, in the light of the failure by the Spanish authorities to notify the aid schemes to the Commission and their lack of cooperation.
Elle rappelle ainsi que l’inaction de la Commission pendant la période comprise entre 1996 et 2000 ne pouvait constituer une approbation implicite de l’aide et ce, au regard de l’absence de notification des régimes d’aides à la Commission et du manque de collaboration des autorités espagnoles.

The appeals against the latter judgment to the Tribunal Constitucional (Spanish Constitutional Court) were dismissed.

Despite the arguments put forward by the Spanish authorities that the measure at issue in the latter case is not selective because Article 37 TRLIS applies to all Spanish undertakings that invest internationally, the Court concluded that the measure constituted State aid since it was limited to one category of undertakings, namely undertakings making certain international investments.

The European Commission has decided to refer Spain to the European Court of Justice because it considers that certain provisions of Spanish law concerning investment in privatised companies constitute unjustified restrictions on the free movement of capital and the right of establishment in violation of EU Treaty rules (Articles 56 and 43).
