With regard to investigation of the complaint, it should be stressed that, in accordance with the ruling given by the Court of Justice in Case C-67/91 (30) (the 'Spanish banks` case), national competition authorities are not entitled to use as evidence, for the purposes of applying either national rules or the Community competition rules, unpublished information contained in replies to requests for information sent to firms under Article 11 of Regulation No 17 or information obtained as a result of any inspections carried out under Article 14 of that Regulation.

Concernant l'instruction de la plainte, il y a lieu de préciser que, conformément à l'arrêt de la Cour de justice dans l'affaire C-67/91 [affaire dite «des banques espagnoles» (30)], les autorités de concurrence des États membres ne sont pas en droit d'utiliser comme moyens de preuve, pour l'application tant des règles nationales que des règles communautaires de la concurrence, les informations non publiées contenues dans les réponses aux demandes de renseignements adressées aux entreprises en application de l'article 11 du règlement n° 17, ainsi que celles obtenues suite aux vérifications effectuées en vertu de l'article 14 dudit règlement.
