The right to vote and stand in elections to the European Parliament is enshrined in Article 19(2) of the EC Treaty and was put into effect by Council Directive 93/109/EC [1] of 6 December 1993 laying down detailed arrangements for the exercise of the right to vote and stand as a candidate in elections to the European Parliament for citizens of the Union residing in a Member State of which they are not nationals [2].

The Member State of residence should be entitled to establish whether an individual would have been deprived of the right to stand for election under the national law of that State under the same circumstances and in the same manner, and to decide on its own behalf whether to recognise the disqualification applicable in the home State.

Previously, an EU citizen wishing to stand for election in another Member State of which s/he was not a national had to provide certification from their Member State of citizenship that they were not disqualified from standing in European Parliamentary elections in that state, As of the 2014 elections, when an EU citizen submits his/her application to stand for election, s/he shall provide a declaration instead of the certification.
