Directive 2004/17/EC of the European Parliament and of the Council of 31 March 2004 coordinating the procurement procedures of entities operating in the water, energy, transport and postal services sectors , Directive 2004/18/EC of the European Parliament and of the Council of 31 March 2004 on the coordination of procedures for the award of public works contracts, public supply contracts and public service contracts , Directive 2009/81/EC of the European Parliament and of the Council of 13 July 2009 on the coordination of procedures for the award of certain works contracts, supply contracts and service contracts by contracting authorities or entities in the fields of defence and security and Commission Regulation (EC, Euratom) No 2342/2002 of 23 December 2002 laying down detailed rules for the implementation of Council Regulation (EC, Euratom) No 1605/2002 on the Financial Regulation applicable to the general budget of the European Communities specify that technical specifications in public procurement should be formulated by reference to national standards transposing European standards, European technical approvals, common technical specifications, international standards, other technical reference systems established by the European standardisation organisations or - when these do not exist - to national standards, national technical approvals or national technical specifications relating to the design, calculation and execution of the works and use of the products, or equivalent.

The European Commission has already taken steps in order to improve the quality of pre-contractual information available to consumers, for instance in the Standard European Consumer Credit Information Sheet, annexed to the new Consumer Credit Directive,[23] and in the Key Investor Information document, being tested for the revision of the UCITS Directive.[24] In the area of mortgages, the examination of the European Standard Information Sheet aims to improve the presentation of pre-contractual information to consumers.[25] The Commission Communication on Packaged Retail Investment Products proposes measures to deliver clear, comparable pre-contractual information to investors of these products.[26] The impact of these measures is to standardise the presentation of pre-contractual information in a way which makes it easier for the consumer to compare the offers of different providers.

Technical specifications shall be formulated by reference to European standards and national standards implementing European standards , European technical approvals, European eco-labels , common technical specifications, international standards or, when these do not exist, national standards or national technical approvals, pluri-national or national eco-labels, requiring third-party certification, environmental management systems or any other technical reference adopted by European standardisation bodies, as defined in Annex XX, provided that the reference is accompanied by the words "or equivalent'.
