Following this important transition, and after initially agreeing the end of the quota system for sugar in 2015, the European Parliament and Member States decided in the 2013 CAP reform to postpone this landmark by two years until the end of the 2016/17 sugar marketing year, i.e. from 30 September 2017.
À la suite de cette importante transition, et après avoir initialement convenu de la fin du système des quotas pour le sucre en 2015, le Parlement européen et les États membres, dans le cadre de la réforme de la PAC de 2013, ont décidé de reporter ce tournant de deux ans, jusqu'à la fin de la campagne de commercialisation du sucre 2016-2017, c'est-à-dire à partir du 30 septembre 2017.

In order to avoid hampering the restructuring of the sugar sector, it is considered necessary to provide for an exemption, at the request of the undertaking, from the withdrawal in the 2007/2008 marketing year or from a possible withdrawal in the 2008/2009 marketing year for those undertakings which in the marketing year of withdrawal concerned have successfully applied for restructuring aid under Regulation (EC) No 320/2006 and which as a result are going to renounce their total quota in the following marketing year.
Pour éviter d’entraver la restructuration du secteur du sucre, il est jugé nécessaire de prévoir une exemption, à la demande de l’entreprise, du retrait au cours de la campagne de commercialisation 2007/2008 ou d’un éventuel retrait au cours de la campagne 2008/2009 pour les entreprises qui, durant la campagne de commercialisation du retrait concerné, ont obtenu une aide à la restructuration au titre du règlement (CE) no 320/2006 et qui, par conséquent, vont renoncer à la totalité de leur quota au cours de la campagne de commercialisation suivante.

3. Approved sugar producers shall pay, before 1 June following the marketing year concerned, an amount equal to EUR 500 per tonne for the quantities of sugar for which they cannot provide proof acceptable to the Member State that the sugar referred to in paragraph 2(c) is not imported sugar not intended for refining or, if it is sugar for refining, that it has not been refined for exceptional technical reasons or due to a case of force majeure

Throughout the marketing years 2006/2007, 2007/2008, 2008/2009 and 2009/2010, the intervention agency designated by each sugar-producing Member State shall buy in, up to a total quantity of 600 000 tonnes, expressed in white sugar, per marketing year for the Community, any white or raw sugar offered to it provided that the sugar concerned:

In line with the recent ruling of the WTO Appellate Body, which found that the production of C sugar benefited from export subsidies by being cross-subsidised from production under A and B sugar, the current Regulation must seek to eliminate C sugar as from the marketing year 2006/2007.
Conformément à la décision récemment rendue par l'organe d'appel de l'OMC, qui a estimé que la production de sucre C bénéficiait de subventions à l'exportation au travers d'un subventionnement croisé opéré à partir de la production de sucre A et B, le règlement à l'examen doit tendre à supprimer le sucre C à compter de la campagne de commercialisation 2006/2007.

The report shall be presented at a time no later than the end of the fourth marketing year to which Council Regulation (EC) No .of .establishing a temporary scheme for the restructuring of the sugar industry in the European Community and amending Regulation (EC) No 1258/1999 on the financing of the common agricultural policy.

(9) Following the recent decisions on export subsidies of the World Trade Organisation Panel and the Appellate Body on EU export subsidies for sugar and in order for Community operators to ensure a smooth change-over from the previous quota system to the present system, it should be possible during the marketing year 2006/2007 for sugar undertakings that produced C sugar in the marketing year 2004/2005 to be allocated an additional quota under conditions that take the lower value of C sugar into account.
(9) Au vu des récentes décisions prises sur les aides à l'exportation par le groupe spécial de l'Organisation mondiale du commerce (OMC) et l'organe d'appel en ce qui concerne les aides communautaires à l'exportation de sucre et afin de permettre aux opérateurs de la Communauté européenne de passer facilement du précédent régime des quotas au régime actuel, il importe que les entreprises sucrières ayant produit du sucre C durant la campagne de commercialisation 2004/2005 puissent bénéficier, pendant la campagne de commercialisation 2006/2007, d'un quota supplémentaire, basé toutefois sur la valeur la plus faible du sucre C produit.

During the marketing years 2006/2007, 2007/2008, 2008/2009 and 2009/2010, the intervention agency appointed by each sugar-producing Member State shall be required, in accordance with the procedure referred to in Article 39(2), to purchase the white sugar and raw sugar produced under quota and manufactured from sugar beet and sugar cane harvested in the Community that is offered to it, subject to prior conclusion of a storage contract between the seller and the said agency for the sugar in question.

Durant les campagnes de commercialisation 2006/2007, 2007/2008, 2008/2009 et 2009/2010, l'organisme d'intervention désigné par chaque État membre producteur de sucre a, conformément à la procédure prévue à l'article 39, paragraphe 2, l'obligation d'acheter le sucre blanc et le sucre brut produits sous quota, fabriqués à partir de betteraves ou de cannes à sucre récoltées dans la Communauté qui lui sont proposés, pour autant qu'il y ait au préalable conclusion d'un contrat de stockage entre l'offrant et ledit organisme pour le sucre en cause.

3. Without prejudice to paragraph 5, the quantities of raw cane sugar and raw beet sugar harvested in the Community available to the refining industry, with or without distinction of origin, shall be determined on the basis of an exhaustive Community forecast supply balance for raw sugar for each marketing year or part of a marketing year.

Sans préjudice du paragraphe 5, sur la base d'un bilan communautaire prévisionnel et exhaustif d'approvisionnement en sucres bruts pour chaque campagne de commercialisation ou partie de campagne, sont déterminées les quantités de sucre brut de canne et de sucre brut de betterave récoltées dans la Communauté avec ou sans distinction d'origine, disponibles pour l'industrie de raffinage.

Hitherto it has been possible to adjust this aid for any given marketing year in line with the storage levy set for that year and/or any change in the refining margin resulting from the prices set for the marketing year in question. In the light of experience, this aid should continue. Given the direct impact on the refining margin of changes in the storage levy, it should be made compulsory for the adjustment aid to be altered in line with that levy in the case of refining of raw sugar covered by Community price guarantees or imported from the ACP states as preferential sugar.
Cette aide pouvait jusqu'ici être ajustée pour une campagne de commercialisation déterminée, compte tenu du montant de la cotisation de stockage fixé pour celle-ci et/ou pour tenir compte d'une modification de la marge de raffinage consécutive aux prix fixés pour la campagne de commercialisation en cause; à la lumière de l'expérience, il est justifié de maintenir cette aide; vu l'influence directe sur la marge de raffinage de l'évolution de la cotisation de stockage, il convient de prévoir un système d'ajustement obligatoire de l'aide d'adaptation en fonction de l'évolution de cette cotisation pour le raffinage des sucres bruts bénéficiant de garanties de prix communautaires ou importés des pays ACP comme sucres préférentiels .
