Whereas the Public Service Commission has decided that it is not practicable nor in the best interests of the Public Service to apply the provisions of the Public Service Employment Act to all persons appointed for a specified period on or after April 1, 1995 for the purpose of being employed by Statistics Canada in the Clerical and Regulatory, Programme Administration, Administrative Services, Information Services and General Services groups in connection with data collection and data processing for the 1996 Census of Population, during the period beginning on April 1, 1995 and ending on March 31, 1997;

(34) Since the objectives of this Regulation, namely clarifying and better defining the role of statutory audit regarding public-interest entities, improving the information that the statutory auditor or the audit firm provides to the audited entity, investors and other stakeholders, improving the communication channels between auditors and supervisors of public-interest entities, preventing any conflict of interest arising from the provision of non-audit services to public-interest entities, mitigating the risk of any potential conflict of interest due to the existing system whereby the auditee selects and pays the auditor or the familiarity threat, facilitating the switching of, and the choice of a statutory auditor or an audit firm to public-interest entities, broadening the choice of statutory auditors and audit firms for public-interest entities and improving the effectiveness, independence and consistency of the regulation and oversight of statutory auditors and audit firms providing statutory audits to public-interest entities including as regards cooperation at Union level, cannot be sufficiently achieved by the Member States but can rather, by reason of their scale, be better achieved at Union level, the Union may adopt measures, in accordance with the principle of subsidiarity as set out in Article 5 of the Treaty on European Union.
(34) Étant donné que les objectifs du présent règlement, à savoir clarifier et mieux définir le rôle du contrôle légal des comptes pour les entités d'intérêt public, améliorer les informations que doit fournir le contrôleur légal des comptes ou le cabinet d'audit à l'entité contrôlée, aux investisseurs et aux autres parties intéressées, améliorer les canaux de communication entre les contrôleurs légaux des comptes et les autorités de surveillance des entités d'intérêt public, empêcher tout conflit d'intérêts résultant de la fourniture de services autres que d'audit aux entités d'intérêt public, atténuer le risque de conflit d'intérêts potentiel lié au système actuel dans lequel l'entité contrôlée sélectionne et paie l'auditeur, ou le risque de familiarité, faciliter le changement et le choix d'un contrôleur légal des comptes ou d'un cabinet d'audit pour les entités d'intérêt public, élargir le choix des contrôleurs légaux des comptes et des cabinets d'audit pour les entités d'intérêt public et améliorer l'efficacité, l'indépendance et la cohérence de la réglementation et de la supervision des contrôleurs légaux des comptes et cabinets d'audit qui procèdent au contrôle légal des comptes des entités d'intérêt public, y compris en ce qui concerne la coopération au niveau de l'Union, ne peuvent pas être atteints de manière suffisante par les États membres mais peuvent, en raison de leur ampleur, l’être mieux au niveau de l'Union, cette dernière peut adopter des mesures, conformément au principe de subsidiarité consacré à l'article 5 du traité sur l'Union européenne.

6. Supports the adoption of the ‘home’ country principle – whereby policies written by an insurer, regardless of location of sale, are covered by the ‘home’ IGS – recognising (a) that under Solvency II the cross-border provision of insurance services will increase, and (b) that the failure of an insurer will be linked to the inadequacy of supervision by the ‘home’ supervisor, so that the burden of responsibility for failure should be borne by the ‘home’ IGS, which should provide last-resort protection to consumers only when insurance undertakings are unable to fulfil their contractual commitments owing to insolvency; calls on the Commission to conduct an impact assessment and public consultation with stakeholders on the inclusion of life insurance as a matter of priority and on the practicality of including non-life insurance in a cross-border IGS to ensure an appropriate level of consumer protection and a level playing field between Member States; believes that a rationale should be established by the Commission and the EIOPA in order to ensure that the additional costs of an IGS are weighed against the objective of consumer protection; notes that the current EU regulation on deposit guarantee schemes and investor protection schemes covers only savings products;
6. soutient l'adoption du principe du «pays d'origine» – selon lequel les contrats d'assurance émis par un assureur, quel que soit le lieu de la souscription, sont couverts par le RGA du «pays d'origine» – en reconnaissant que a) en raison de l'introduction de la directive «Solvabilité II», la prestation transfrontalière de services d'assurance connaîtra une progression et que b) la faillite d'un assureur sera liée à l'insuffisance du contrôle exercé par l'autorité du «pays d'origine» si bien que la responsabilité de cette faillite devrait être assumée par le RGA du «pays d'origine», qui devrait fournir une protection en dernier ressort aux consommateurs exclusivement lorsque des entreprises d'assurance, en raison de leur insolvabilité, sont incapables de tenir leurs engagements contractuels; invite la Commission à mener une étude d'impact et une consultation publique des parties prenantes en priorité sur l'intégration de l'assurance vie et sur la possibilité d'inclure l'assurance non-vie dans un RGA transfrontalier afin d'assurer un degré approprié de protection des consommateurs et des conditions égales entre les États membres; estime que la Commission et l'AEAPP devraient poser le principe que les coûts supplémentaires d'un RGA sont mis en balance avec l'objectif de la protection des consommateurs; relève que la législation de l'Union en vigueur sur les régimes de garantie des dépôts et les régimes de protection des investisseurs ne couvre que les produits d'épargne;
