By the first ground of appeal, the appellants claim that the General Court attributed to them the anti-competitive conduct of SKW Stahl-Technik GmbH Co. KG (‘SKW’) in breach of the range of the attribution of liability under Article 81 EC (now Article 101 TFEU), the principle of personal responsibility, the presumption of innocence and the principle that liability presupposes fault by rejecting the rebuttal of the presumption of decisive influence.
Par le premier moyen, les requérantes critiquent le fait que, en violation de la portée de l’imputation de la responsabilité découlant de l’article 81 CE (actuel article 101 TFUE), du principe de responsabilité personnelle, de la présomption d’innocence et du principe de la responsabilité pour faute, le Tribunal lui a imputé le comportement contraire au droit des ententes de SKW-Stahl-Technik GmbH Co. KG (ci-après «SKW») en ce qu’il a rejeté le renversement de la présomption d’influence décisive.
