In view of the continued brutal repression and violation of human rights by the Government of Syria, Council Decision 2011/782/CFSP provides for additional measures, namely a prohibition on the export of telecommunications monitoring equipment for use by the Syrian regime, a prohibition on the participation in certain infrastructure projects and investment in such projects, and additional restrictions on the transfers of funds and the provision of financial services.

(24) The abolition of special and exclusive rights in the telecommunications markets will allow undertakings enjoying special and exclusive rights in sectors other than telecommunications to enter the telecommunications markets. In order to allow for monitoring under the applicable rules of the Treaty of possible anti-competitive cross-subsidies between, on the one hand, areas for which providers of telecommunications services or telecommunications infrastructures enjoy special or exclusive rights and, on the other, their business as telecommunications providers, Member States should take the appropriate measures to achieve transparency as regards the use of resources from such protected activities to enter in the liberalized telecommunications market. Member States should at least require such undertakings once they achieve a significant turnover in the relevant telecommunications service and/or infrastructure provision market, to keep separate financial records, distinguishing between inter alia, costs and revenues associated with the provision of services under their special and exclusive rights and those provided under competitive conditions. For the time being, a turnover of more than ECU 50 million could be considered as a significant turnover.
(24) considérant que l'abolition des droits spéciaux et exclusifs sur le marché des télécommunications permettra à des entreprises bénéficiant de tels droits dans des secteurs autres que celui des télécommunications de prendre pied sur ce marché; que, afin de permettre le contrôle en vertu des règles pertinentes du traité, d'éventuelles subventions croisées abusives entre, d'une part, les domaines dans lesquels les fournisseurs de services ou d'infrastructures de télécommunications bénéficient de droits spéciaux ou exclusifs et, d'autre part, leurs activités sur le marché des télécommunications, les États membres devraient prendre les mesures nécessaires pour réaliser la transparence quant à l'utilisation des ressources provenant de ces domaines d'activités protégés pour pouvoir accéder au marché des télécommunications libéralisé; qu'il sera nécessaire, pour ce faire, d'imposer au minimum à ces entreprises de tenir, dès qu'elles réalisent un chiffre d'affaire significatif dans le marché concerné de la fourniture de services ou d'infrastructure de télécommunications, des comptes financiers distincts qui fassent apparaître séparément les produits et les charges liés aux services fournis en vertu de leurs droits spéciaux et exclusifs et ceux liés aux services fournis en situation de concurrence; que, à l'heure actuelle, un chiffre d'affaires de plus de 50 millions d'écus peut être considéré comme un chiffre d'affaires significatif;

(7) In addition, the abolition of exclusive and special rights on the provision of voice telephony would have little or no effect, if new entrants would be obliged to use the public telecommunications network of the incumbent telecommunications organizations, with whom they compete in the voice telephony market. Reserving to one undertaking which markets telecommunications services the task of supplying the indispensable raw material, i.e. the transmission capacity, to all its competitors would be tantamount to conferring upon it the power to determine at will where and when services can be offered by its competitors, at what cost, and to monitor their clients and the traffic generated by its competitors, placing that undertaking in a position where it would be induced to abuse its dominant position. Directive 90/388/EEC did not explicitly address the establishment and provision of telecommunications networks, as it granted a temporary exception under Article 90 (2) of the Treaty in respect of exclusive and special rights for the by far most important service in economic terms provided over telecommunications networks, i.e. voice telephony. However, the Directive provided for an overall review by the Commission of the situation in the whole telecommunications sector in 1992.
(7) considérant en outre que l'abolition des droits exclusifs et spéciaux en ce qui concerne l'offre de téléphonie vocale n'aurait que peu ou pas d'effet si les nouveaux entrants étaient obligés d'utiliser le réseau public de télécommmunications de l'organisme de télécommunications en place qu'ils veulent concurrencer sur le marché de la téléphonie vocale; que le fait de réserver à une entreprise qui vend des services de télécommunications la tâche de fournir à ses concurrents la matière première indispensable dans ce domaine, c'est-à-dire la capacité de transmission, revient à lui conférer le pouvoir de déterminer à son gré où, quand et à quel coût ces derniers peuvent offrir leurs services, et de surveiller leurs clients et le trafic généré par ceux-ci; que cela revient à placer cette entreprise dans une situation où elle serait incitée à abuser de sa position dominante; que la directive 90/388/CEE ne traite pas explicitement de la construction et de l'exploitation de réseaux de télécommunications, parce qu'elle accorde une exception temporaire au titre de l'article 90 paragraphe 2 du traité en ce qui concerne les droits exclusifs et spéciaux pour le service le plus important en termes économiques fourni sur des réseaux de télécommunications, à savoir la téléphonie vocale; que cette directive prévoyait néanmoins un examen par la Commission de la situation de l'ensemble du secteur des télécommunications en 1992;

(14) Moreover in order to allow the monitoring of interconnection obligations under competition law, the cost accounting system implemented with regard to the provision of voice telephony and public telecommunications networks should, during the time period necessary to allow for effective market entry, clearly identify the cost elements relevant for pricing interconnection offerings and, in particular for each element of the interconnection offered, identify the basis for that cost element, in order to ensure in particular that this pricing includes only elements which are relevant, namely the initial connection charge, conveyance charges, the share of the costs incurred in providing equal access and number-portability and of ensuring essential requirements and, where applicable, supplementary charges aimed to share the net cost of universal service, and provisionally, imbalances in voice telephony tariffs. Such cost accounting should also make it possible to identify when a telecommunications organization charges its major users less than providers of voice telephony networks.
(14) considérant que, en outre, pour permettre le contrôle des obligations d'interconnexion en vertu du droit de la concurrence, la méthode de comptabilité analytique adoptée pendant la période nécessaire à l'entrée effective sur le marché de concurrents pour l'offre de téléphonie vocale et du réseau public de télécommunications sous-jacent devrait permettre une identification précise des éléments de coûts intégrés dans la redevance d'interconnexion, et en particulier pour chaque élément de l'offre d'interconnexion la base de coût utilisée, afin de permettre de s'assurer que celle-ci ne contient que des éléments pertinents, à savoir la redevance initiale de connexion, les frais d'acheminement, la quote-part de frais supportés pour assurer l'égalité d'accès, la portabilité du numéro et le respect des exigences essentielles et, le cas échéant, les redevances d'accès visant à partager le coût net du service universel et, provisoirement, pour compenser les déséquilibres dans la structure tarifaire de la téléphonie vocale; qu'une telle comptabilité devrait d'autre part permettre de déceler quand l'organisme de télécommunications facture plus aux opérateurs de réseaux de téléphonie vocale qu'aux grands utilisateurs de son réseau;
