Taking into account the high number of temporary staff within agencies and the need to define a consistent staff policy, it is necessary to create a new category of temporary staff and to lay down specific rules for that category.

As regards the grade in which a member of staff seconded from a Member State’s national diplomatic service is placed upon his appointment by an EU body as a member of its temporary staff, the functions previously performed by the person concerned as a seconded national expert within that same body cannot be taken into consideration for the purposes of comparison with the functions corresponding to the post occupied as a member of the temporary staff since, as a seconded national expert, he was not eligible for grading under the Staff Regulations.

An institution did not step beyond the bounds of the first paragraph of Article 8 of the Conditions of employment of other servants by amending a contract as a member of the temporary staff, within the meaning of Article 2(a) of those Conditions of employment, in order to cancel the fixed period of the contract and replace it by what is alleged to be an indefinite period and also to include a termination clause in the event that the member of staff is not included in the reserve list of a competition.

In the event of the death of a former member of the temporary staff within the meaning of Article 2(a), (c) or (d) who leaves the service before reaching 63 years of age and requests that his retirement pension be deferred until the first day of the calendar month following that in which he reaches 63 years of age, children deemed to be his dependants in accordance with Article 2 of Annex VII to the Staff Regulations shall be entitled to an orphan's pension on the same terms as those set out in the preceding paragraphs.

However, only the number of years of service completed by staff as temporary staff within the meaning of Article 2 (d) shall be taken into account for the purpose of calculating the years of pensionable service within the meaning of Article 2 of Annex VIII to the Staff Regulations.
