The package includes two main elements: a proposal for a Directive on Terrorism, which will strengthen the EU's arsenal in preventing terrorist attacks by criminalising preparatory acts such as training and travel abroad for terrorist purposes as well as aiding or abetting, inciting and attempting terrorist acts; an Action Plan to step up the fight against criminals and terrorists accessing and using weapons and explosives through a reinforced control of illicit possession and import to the EU.

These include in particular the replacement of structured and hierarchical groups by semi-autonomous cells or lone actors and the increased use of the internet to inspire, mobilise, instruct and train local terrorist networks and individuals.[9] The provisions in place to implement FD 2002 were considered insufficient in that conduct such as disseminating messages of public provocation which did not actually incite a particular person to commit a terrorist offence, disseminating messages encouraging people to become terrorists without reference to a specific terrorist offence, or disseminating on the internet terrorist expertise not aimed at supporting the activities of a specific terrorist group, were not necessarily criminalised.

The report on the implementation of the revised strategy for terrorist financing (15062/11), drawn up in cooperation with the Commission, highlights a number of issues: recent trends in terrorist financing have shown that terrorism and crime tend to be increasingly linked with each other; terrorist groups rely increasingly on ransom money for their financing (amounts which in some places far exceed any other financing methods); terrorist groups are increasingly dependent on cash couriers and informal remittances.

In the other Member States considered here, the technique used to define terrorist offences raises some concerns: Luxembourg does not foresee a catalogue of terrorist offences, Slovenia uses only a general definition of terrorist offences, Lithuania appears to lack a complete definition and Poland only defines terrorist intent.

Regarding penalties, it introduces a principle of "aggravating circumstance" by providing that "terrorist offences" and certain offences linked to terrorism must be punishable by custodial sentences heavier than those imposable under national law for such offences in the absence of a terrorist intent, it sets the minimum level of the maximum penalty at 15 years for directing a terrorist group and 8 years for participation in a terrorist group, it enumerates a series of penalties that can be imposed on bodies corporate (in particular exclusion from entitlement to public benefits or aid, temporary or permanent disqualification from the practice of commercial activities, placing under judicial supervision, judicial winding-up order and closure of establishments), it provides for a system of "repentis" by providing for specific circumstances in which Member States may reduce prison sentences where the terrorist renounces terrorist activity or provides the administrative or judicial authorities with information.

The Council decided on 12 September - by written procedure - to update the European Union list of terrorist organisations and persons linked to terrorist activities, which was first adopted in December 2001 in the wake of the terrorist attacks on 11 September and last updated on 27 June 2003.
