The European Parliament is of the opinion that the legislative act to be adopted should lay down specific rules concerning the law applicable to the form of testamentary clauses – which clauses are to be regarded as valid if they are considered as such by the law of the State in which the testator drew them up, or by the law of the State in which the testator had his habitual residence at the time when he drew up the will or died, or by the law of one of the States of which the testator was a national at the time when he drew up the will or died;
Le Parlement européen est d'avis que l'acte législatif à adopter devra prévoir des règles appropriées en ce qui concerne la loi applicable à la forme des dispositions testamentaires, lesquelles devront, quant à la forme, être considérées valides si elles sont considérées comme telles par la loi de l'État dans lequel le testateur a disposé; ou par la loi de l'État où le testateur avait sa résidence habituelle, au moment où il a disposé ou au moment de son décès; ou par la loi d'un des États membres dont le testateur avait la nationalité, au moment où il a disposé ou au moment de son décès.
